September 26, <br /> <br /> UP-95-15 <br /> <br />1995 <br /> <br />2A5 <br /> <br /> Beginning on the north side of Bain Street's right-of-way <br />55'~ west of it's intersection with Williamsburg Avenue; thence, <br />north 110'~ to a point; thence, west 50~ to a point; thence, <br />south 110'~ to a point; thence, east 50'~ to the point of the <br />beginning. <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) Occupancy of the facility shall be limited to eight (8) <br />re~i~ents, aged fifty-five (55) .or older or with some limits in <br />ability for self care, and to required staff members. <br /> <br />(b) Prior to occupancy and at least annually thereafter, the <br />facility shall request an inspection by the Fire Prevention <br />Bureau, the Public Health Department and the Building Official <br />and shall correct any noted deficiencies. <br /> <br />(c) The facility shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments, and shall obtain and maintain in effect all <br />necessary licenses and permits. <br /> <br />(d) The applicants shall provide two (2) off-street parking <br />spaces approved by the City Engineering Department prior to the <br />issuance of a certificate of occupancy. <br /> <br />(e) The use permit shall not be transferable. <br /> <br />(f) Except as hereby amended, the facility shall be operated in <br />accordance with the narrative description submitted by the <br />applicants and which is attached hereto as Exhibit A and made a <br />part hereof." <br /> <br />Ayes: Clemon, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Clemons, to <br />adopt the following resolution, and was adopted by the following <br />vote: <br /> <br />95-412 (c): <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT TO DELBERT B. GLENN FOR <br />THE OPERATION OF AN ADULT RESIDENTIAL CARE FACILITY AT 104 UTAH <br />STREET. <br /> <br /> WHEREAS, Delbert B. Glenn has made application pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) for the granting of a use permit to operate an adult <br />residential care facility to be located at 104 Utah Street, <br />Virginia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of pOrtsmouth, Virginia: <br /> <br /> <br />
