That Trinity Episcopal Church is hereby granted a use <br />permit pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouth, Virginia (1988) for the operation of a child day <br />care facility on property located at 500 Court Street, and being <br />more particularly described as: <br /> <br />UP-95-20 <br /> <br /> Beginning at the southwest corner of the intersection of <br />High Street and Court Street; thence, west 182'± to a point; <br />thence, south 239'± to a point; thence, east 182'~ to a point; <br />thence, 239'± to the point of the beginning. <br /> <br /> 3. That this use permit ms approved subject to the <br />following conditions: <br /> <br />(a) Occupancy of the facility shall be limited to no more than <br />thirty-eight (38) children. <br /> <br />(b) Indoor hours of operation shall be limited to the hours of <br />6:00 A.M. through 6:00 P.M. <br /> <br />(c) Prior to occupancy, the applicant shall submit and have <br />approved by the City a parking plan that will accommodate five <br />(5) vehicles. <br /> <br />(d) Prior to occupancy and at least annually thereafter, the <br />facility shall request an inspection by the Fire Prevention <br />Bureau, the Public Health Department and the Building Official <br />and shall correct any noted deficiencies. <br /> <br />(e) The facility shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />goverrnnents, and shall obtain and maintain an effect all <br />necessary licenses and permits. <br /> <br />(f) The use permit shall not be transferable. <br /> <br />(g) The project shall be developed in accordance with submitted <br />site and floor plans as approved by the City." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />95-412 Use Permits: <br /> <br />95-412 (e): <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT TO ST.
