27'0 <br /> <br />October~24,' 1995 <br /> <br />{d) The use permit shall not be transferable. <br /> <br />(e) The facility shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments, and shall obtain and maintain in effect all <br />necessary licenses and permits~ ~ - <br /> <br /> (f) The applicant shall save as many of the existing <br />trees on the site as is practicable. <br /> <br /> (g) The applicant shall develop a Group I landscaping <br />buffer between the site and the adjacent railroad <br />right-of-way. " <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Robinett, to <br />adopt the following ordinance, approved at the Public Hearing <br />meeting on October 9, 1995, and was adopted by the following <br />vote: <br /> <br />95-455 (d): <br /> <br /> "ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING TABLE 40-43.1-3 <br />THEREOF, PERTAINING TO THE OPERATION OF CHILD DAY CARE <br />FACILITIES IN CERTAIN DOWNTOWN D-1 AND D-2 ZONING <br />SUBDISTRICTS." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Robinett, to <br />adopt the following resolution, approved on first reading at <br />the Public Hearing meeting on October 9, 1995, and was adopted <br />by the following vote: <br /> <br />95-455 (e): <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT TO TRINITY EPISCOPAL <br />CHURCH FOR THE OPERATION OF A CHILD DAY CARE FACILITY AT 500 <br />COURT STREET. <br /> <br /> WHEREAS, Trinity Episcopal-Church has made application <br />pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouth, Virginia (1988) for the granting of a use permit to <br />operate a child day care care facility to be located at 500 <br />Court Street, Portsmouth, Virginia, as hereinafter-described; <br />and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit With conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit hereinafter- <br />described is sought: <br /> <br /> (a) <br />persons <br /> <br /> Will not adversely affect the health and safety of <br />residing or working in the neighborhood of the proposed <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements in the neighborhood; <br /> <br /> <br />
