27'0 October~24,' 1995 {d) The use permit shall not be transferable. (e) The facility shall comply with all applicable codes, ordinances and regulations of federal, state and local governments, and shall obtain and maintain in effect all necessary licenses and permits~ ~ - (f) The applicant shall save as many of the existing trees on the site as is practicable. (g) The applicant shall develop a Group I landscaping buffer between the site and the adjacent railroad right-of-way. " Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: None Motion by Mr. Pitts, and seconded by Mr. Robinett, to adopt the following ordinance, approved at the Public Hearing meeting on October 9, 1995, and was adopted by the following vote: 95-455 (d): "ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING TABLE 40-43.1-3 THEREOF, PERTAINING TO THE OPERATION OF CHILD DAY CARE FACILITIES IN CERTAIN DOWNTOWN D-1 AND D-2 ZONING SUBDISTRICTS." Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: None Motion by Mr. Clemons, and seconded by Mr. Robinett, to adopt the following resolution, approved on first reading at the Public Hearing meeting on October 9, 1995, and was adopted by the following vote: 95-455 (e): "A RESOLUTION GRANTING A USE PERMIT TO TRINITY EPISCOPAL CHURCH FOR THE OPERATION OF A CHILD DAY CARE FACILITY AT 500 COURT STREET. WHEREAS, Trinity Episcopal-Church has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a child day care care facility to be located at 500 Court Street, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit With conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter- described is sought: (a) persons Will not adversely affect the health and safety of residing or working in the neighborhood of the proposed (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood;
