2;72 <br /> <br />~'October 24,:~1995 <br /> <br /> WHEREAS, the applicant and. the Planning Director have done <br />all things required to be do~e in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit hereinafter- <br />described is sought: <br /> <br /> (a) Will not adversely affect the'health and <br />persons residing or working in the nelgb_borhood of <br />use; <br /> <br />safety of <br />the proposed <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or ~mprovements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to <br />insure compatibility with surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to <br />a plan for parking, driveways, and curb cuts which will provide <br />for safe and convenient traffic movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City <br />of Portsmouth Zoning Ordinance. <br /> <br /> 2. That St. Mark's Church of Deliverance is hereby <br />granted a use permit pursuant to Section 40-43.1 of the Code of <br />the City of Portsmouth, Virginia (1988) for a church to be <br />located at 611-619 Washington Street, and being more <br />particularly described as: <br /> <br />UP-95-18 <br /> <br /> Beginning at the northeast corner of the intersection of <br />Washington Street and County Street; thence, east 180'± to a <br />point; thence, north 81'± to a point; thence, west 31'± to a <br />point; thence, north 72'± to a point; thence, west 146'± to a <br />point; thence, south 155'± to the point of the beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) All exterior alterations to the site and to any building <br />must be reviewed and approved by the Downtown Design Committee. <br />The exterior of the former bus station shall conform to the <br />elevation dated October 9, 1995, and submitted by the applicant <br />{Exhibit A). Said Exhibit A is attached hereto and made a part <br />hereof. Minor alterations to the elevation may be authorized by <br />the Committee. <br /> <br />(b) The facility shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />gover~.ments. <br /> <br />(c) If the parking plan does not provide a minimum of fifty <br />(50) spaces, the applicant must seek a parking exception." <br /> <br />Ayes: Clemons, Hawks, Martin, Robinett, Webb <br />Nays: Griffin, Pitts <br /> <br /> <br />
