2;72 ~'October 24,:~1995 WHEREAS, the applicant and. the Planning Director have done all things required to be do~e in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter- described is sought: (a) Will not adversely affect the'health and persons residing or working in the nelgb_borhood of use; safety of the proposed (b) Will not be detrimental to the public use or injurious to the property or ~mprovements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That St. Mark's Church of Deliverance is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for a church to be located at 611-619 Washington Street, and being more particularly described as: UP-95-18 Beginning at the northeast corner of the intersection of Washington Street and County Street; thence, east 180'± to a point; thence, north 81'± to a point; thence, west 31'± to a point; thence, north 72'± to a point; thence, west 146'± to a point; thence, south 155'± to the point of the beginning. 3. That this use permit is approved subject to the following conditions: (a) All exterior alterations to the site and to any building must be reviewed and approved by the Downtown Design Committee. The exterior of the former bus station shall conform to the elevation dated October 9, 1995, and submitted by the applicant {Exhibit A). Said Exhibit A is attached hereto and made a part hereof. Minor alterations to the elevation may be authorized by the Committee. (b) The facility shall comply with all applicable codes, ordinances and regulations of federal, state and local gover~.ments.
