WHEREAS home for adu~ use permit (UP-87-15) Council resolution dated July 28, ..... 269 October 24, 1995 ! House, L.P., currently operates a group ~erty adjoining said address pursuant to a granted to Bullock Corporation by City 1987; and Whereas, the applicant desires to combine its current and proposed activities under a single use permit; and WHEREAS, the applicant and the Plan~ing Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter- described is sought: (a) Will not adversely affect the health and persons residing or working in the neighborhood of safety of the proposed (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Churchland House, L.P., is hereby granted a use permit pursuant to Section 40-43.~ of the Code of the City of Portsmouth, Virginia (1988) for the operation of an adult residential care facility on property located at 3911 Cedar Lane, and being more particularly described as: qP.-95-19 Beginning at the southeast corner of the intersection of Cedar Lane and the Norfolk, Franklin and Danville Railway right-of-way; thence, south 125'± to a point; thence, east 237'± to a point; thence~ north 13~'~ to a point; thence, west 180'~ to a point; thence, in a southwesterly direction 49'± to the point of the beginning. 3. That this use permit is approved subject to the following conditions: (a) Occupancy of the facility shall be limited to seventy-two (72) residents, aged fifty-five (55) or older, and to required staff members. (b) Prior to occupancy and at least annually thereafter, the facility shall request an inspection by the Fire Prevention Bureau, the Public Health Department and the Building Official and shall correct all noted deficiencies. (c) The project shall be developed in accordance with submitted site and floor plans as approved by the City.
