WHEREAS <br />home for adu~ <br />use permit (UP-87-15) <br />Council resolution dated July 28, <br /> <br />..... 269 <br /> October 24, 1995 <br /> <br /> ! House, L.P., currently operates a group <br /> ~erty adjoining said address pursuant to a <br /> granted to Bullock Corporation by City <br /> 1987; and <br /> <br /> Whereas, the applicant desires to combine its current and <br />proposed activities under a single use permit; and <br /> <br /> WHEREAS, the applicant and the Plan~ing Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit hereinafter- <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and <br />persons residing or working in the neighborhood of <br /> <br />safety of <br />the proposed <br /> <br /> (b) Will not be detrimental to the public use or injurious <br />to the property or improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure <br />compatibility with surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to <br />a plan for parking, driveways, and curb cuts which will provide <br />for safe and convenient traffic movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br /> 2. That Churchland House, L.P., is hereby granted a use <br />permit pursuant to Section 40-43.~ of the Code of the City of <br />Portsmouth, Virginia (1988) for the operation of an adult <br />residential care facility on property located at 3911 Cedar <br />Lane, and being more particularly described as: <br /> <br />qP.-95-19 <br /> <br /> Beginning at the southeast corner of the intersection of <br />Cedar Lane and the Norfolk, Franklin and Danville Railway <br />right-of-way; thence, south 125'± to a point; thence, east 237'± <br />to a point; thence~ north 13~'~ to a point; thence, west 180'~ <br />to a point; thence, in a southwesterly direction 49'± to the <br />point of the beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) Occupancy of the facility shall be limited to seventy-two <br />(72) residents, aged fifty-five (55) or older, and to required <br />staff members. <br /> <br />(b) Prior to occupancy and at least annually thereafter, the <br />facility shall request an inspection by the Fire Prevention <br />Bureau, the Public Health Department and the Building Official <br />and shall correct all noted deficiencies. <br /> <br />(c) The project shall be developed in accordance with submitted <br />site and floor plans as approved by the City. <br /> <br /> <br />
