That ~r the execution and delivery of the <br />Service Agreemen proper officers, agents and employee~ of <br />the City as the City Manager may determine are hereby <br />authorized, empowered and directed to do all such acts and <br />things and to execute all such documents as may be necessary to <br />carry out and comply with the provisions thereof as executed, <br />and further are authorized to take any and all additional <br />actions and to execute and deliver any and all other <br />certificates and documents as may be necessary in connection <br />therewith." <br /> <br />Ayes: Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays~ Clemons <br /> <br />95-478 Letter from the Acting City Manager recommending <br />adoption of a resolution authorizing condemnation proceedings <br />for a cemetery located within the block bounded by PortCentre, <br />5th Street, Madison Street and Edwards Street. <br /> <br /> ',Portsmouth Redevelopment and Housing Authority (PRHA) has <br />informed the City that there is a small cemetery located in the <br />southside project, for which it has never acquired title. Under <br />the Virginia Code, PRHA does not have the authority to condemn <br />said property. The one body believed to be interred on this <br />site will be reinterred in a public cemetery. <br /> <br /> I, therefore, recommend adoption of this resolution <br />expressing the necessity for the City to acquire this property <br />by eminent domain proceedings for public purposes." <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Martin, to adopt <br />the following resolution, and was adopted by the following vote: <br /> <br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN <br />PROPERTY OWNED BY GEORGE HARVEY BURROUGHS, ROBERT C. BURROUGHS, <br />MILOI D. BURROUGHS AND/OR THEIR HEIRS, DEVISEES OR SUCCESSORS IN <br />TITLE, AND UNKNOWN PARTIES UNDER EMINENT DOMAIN PROCEEDINGS <br />PURSUANT TO THE CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA. <br /> <br /> WHEREAS, the Council of the City of Portsmouth has <br />determined that there is an abandoned and unused cemetery of 12 <br />feet square located in that block of the City bounded by <br />PortCentre Parkway, Madison, Fifth and Edwards Streets, which <br />saidi land is necessary for the public purpose of redevelopment <br />of that area formerly known as "Newtown", and now referred to as <br />"Southside"; and <br /> <br /> WHEREAS, efforts to reach an agreement as to purchase <br />price, and/or purchase of the property have proved unsuccessful <br />in that the City has been unable to make contact with any person <br />believed to be an owner of said property; and <br /> <br /> WHEREAS, the use of said property for the redevelopment and <br />general welfare of the City will be unreasonably delayed if said <br />property is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> <br />
