October 24', ~1995 <br /> <br /> "On September 20, 1995; the Hsanpton Roads Regional Jail <br />Authority approved a service ~agreement among the four member <br />jurisdictions of the Authority. This agreement sets forth in <br />detail the responsibilities of the Authority of the <br />development, operations and maintenance of the jail as well as <br />the co~L=LLitment of the localities'as to their use of the <br />facility. <br /> <br /> Specifically, the agreement outlines the number of inmates <br />which each locality must commit to the new jail, and it defines <br />how the per diem rate for each inmate will be calculated. <br />Under the terms of the agreement, Portsmouth is required to <br />co,unit 250 prisoners to the regional jail and to maintain that <br />number. The agreement also defines how additional inmates <br />above the minimum requirement are to be allocated and paid for. <br /> <br /> As you know from previous briefings on this matter, <br />Portsmouth will benefit from a reduced per diem rate because: <br />the other jurisdictions will pay 25% of Portsmouths Capital <br />cost; Portsmouth will not pay for any of the cost associated <br />with acquisition of the site; and Portsmouth will receive an <br />annual payment in lieu of taxes which is to be paid entirely by <br />the other member jurisdictions. <br /> <br /> Before this agreement becomes effective, it must be <br />approved by all four member jurisdictions of the Authority. <br />recommend that you adopt a resolution authorizing the Acting <br />City Manager to execute the Service Agreement." <br /> <br /> Motion by Mr. Pitts, <br />the following resolution, <br />vote: <br /> <br />and seconded by Mr. Hawks, to adopt <br />and was adopted by the following <br /> <br /> "A RESOLUTION OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />APPROVING THE SERVICE AGREEMENT AMONG THE CITY, THE AUTHORITY <br />AND THE OTHER MEMBER ~URISDICTIONS. <br /> <br /> WHEREAS, the Hampton Roads Regional Jail Authority (the <br />'~Authority") was created by the Cities of Hampton, Norfolk, <br />Newport News and Portsmouth (Collectively, the "Member <br />Jurisdictions") for the purpose of developing a regional jail; <br />and <br /> <br /> WHEREAS, the Authority and the Member Jurisdictions have <br />negotiated a Service Agreement which sets forth in greater <br />detail the duties and responsibilities of the Authority in <br />connection with the development, operations and maintenance of <br />the regional jail, and the agreement of the Member <br />Jurisdictions as to their use of the facility; and <br /> <br /> WHEREAS, the Authority has approved the Service Agreement <br />in the form presented to the Council and recommends approval <br />thereof by all Meanber Jurisdictions, and the Council concurs in <br />such recommendation. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, as follows: <br /> <br /> 1. That the Service Agreement is approved in the form <br />presented to this meeting. <br /> <br /> 2o That the City Manager is authorized to execute and <br />deliver the Service Agreement to the Authority and each other <br />Member Jurisdiction, as appropriate. <br /> <br /> <br />
