March <br /> <br /> On motion of Mr. Maup~n it w~s referred back to the City Attorney to estab!ish~ <br />the fact of Mr. Eley~s residence in Portsmouth. <br /> <br />The following letter from the Oity Attorney was res~i: <br /> <br />Honorable Oily Oouncil, <br />Portsmouth, Virginia. <br /> <br />"Portsmouth, V~. <br /> <br />March 9,1931. <br /> <br /> At your meeting of Jsmuary 27, 1931, the petition of J. F.0~Oonnor and <br />others, Trustees of Portsmouth Lodge B.P.O. Elks, asking that they be relieved of taxes <br />for the year 1918 on the property at the southeast corner of 0curt and North Streets, was <br />referred to me. This property, prior to 1918 a~d after 1919, w~s used for lodge p-o~vposes <br />s~ud w~s not assessable for taxation~ Du~ing the two years just mentioned it w~s occupied <br />by a nurses' home for nurses stationed at the Naval Hospital du~ing the World War, and <br />the United States Government paid the Elks One Hundred ~nd Fifteen ($115.00) Dollars per <br />month rental. I am informed %h~t the Elks did not care to rent their property and that <br />the Government authorities threatened to confiscate it and it, being a p~tr~otic organi- <br />zation, did not care to be put in this position. The property was turned over to the <br />Government ~nd the Elks rented the home of the late O. W. Walker, then located mt the <br />corner of High and Dinwlddie ~reets. The Elks claim that when their property at the <br />corner of 0curt and North ~treets was returned to them it was in a bad state of repairs <br />and the Government refused to compensate them for thei~ loss, which they claimed to have <br />sustained in the transaction. As the property was not used for lodge purposes in 1918 <br />and 1919, and revenue was being received therefrom, the Oommissioner of the Revenue as- <br />sessed it for taxation. In November 1929 the Trustees of the Elks netitioned the Oo~m- <br />oil to relieve the t~xes for 1919. I understand that they did not-know that it was <br />also assessed for 1918. Under the above facts, the Oity 0ounoil relieved the 1919 taxes. <br />It w~s considered at that time that it was a case brought on by the exigencies of the <br />World War, without solicitation of the Elksand without profit to the orgs~uization. The <br />same conditions prevail as to~the 1918 tax~s as to the 1919 t~xes. The taxes for the <br />year amodnt to the sum of One Hundred s~ud Eighty ($180.00) Dollars. <br /> <br />Yours very truly, <br /> <br /> On motion <br />from thc payment of <br /> <br />R. ~.
