November 14, 1995 Motion by Mr..Martin, and seconded by Mr. adopt the following resolution, vote: 299 Robinett, to and was adopted by the following "A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE ALL EASEMENTS AND DEVELOPMENT AGREEMENTS AND AMENDMENTS THERETO PERTAINING TO THE KINGS CROSSING PROJECT, AND TO EXECUTE NEW EASEMENTS WHERE NECESSARY AND APPROPRIATE FOR COMPLETION OF THE PROJECT. WHEREAS, Portsmouth Redevelopment and Housing Authority is the owner of that property known as the Kings Crossing Project, which it has contracted to convey to a developer, which is subject to easements and development agreements executed prior to construction that require release in order to provide for a proper transfer of title; and WHEREAS, new easements will be required for an orderly completion of the project an conformance to a development agreement with the proposed developer. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager of the City of Portsmouth be, and he hereby is authorized to execute such documents as are necessary to effect the release of all easements to the City of Portsmouth on that property known as the Kings Crossing Pro~ect, and development agreements and amendments thereto. BE IT FURTHER RESOLVED, that the City Manager be, and he hereby is authorized to execute easements to Portsmouth Redevelopment and Housing Authority for drainage for Parcel 61A-1 and over and across Parcels 61E, 61F-1 and 61H; to execute a vasual easement for Parcels 61A-1 over and across Parcels 61E, 61F-1 and 61H; to execute an easement providing authority for the construction, and maintenance of a retaining wall along the northern boundary of Parcel 61F-1; and to execute an easement of ingress and egress over and across Parcel 61D providing for access to and from commercial development to be established on Parcel 61A-1 adjacent to its southern boundary. BE IT FURTHER RESOLVED, that the City Manager be, and he hereby is authorized to execute such other documents, and take such other action(s) as he may deem necessary, and in the best interest of the City of Portsmouth to effect completion of the Kings Crossing Project." "The Corps of Engineers has proposed a reconnaissance study of the Elizabeth River. The purpose of this study will be to ~ook at existing conditions, problems, needs and options to improve water quality and aesthetics of the river. There as no Cost to the City for this effort. It has been requested by the orps and by Secretary of Natural Resources Becky Norton Dunlop, however, that area cities endorse this proposal. The attached ~esolution, if approved, will become part of the Corps' package Go request federal funding for the study.
