November 14, 1995 <br /> <br /> Motion by Mr..Martin, and seconded by Mr. <br />adopt the following resolution, <br />vote: <br /> <br />299 <br /> <br /> Robinett, to <br />and was adopted by the following <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE ALL <br />EASEMENTS AND DEVELOPMENT AGREEMENTS AND AMENDMENTS THERETO <br />PERTAINING TO THE KINGS CROSSING PROJECT, AND TO EXECUTE NEW <br />EASEMENTS WHERE NECESSARY AND APPROPRIATE FOR COMPLETION OF THE <br />PROJECT. <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority is <br />the owner of that property known as the Kings Crossing Project, <br />which it has contracted to convey to a developer, which is <br />subject to easements and development agreements executed prior <br />to construction that require release in order to provide for a <br />proper transfer of title; and <br /> <br /> WHEREAS, new easements will be required for an orderly <br />completion of the project an conformance to a development <br />agreement with the proposed developer. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager of the City of <br />Portsmouth be, and he hereby is authorized to execute such <br />documents as are necessary to effect the release of all <br />easements to the City of Portsmouth on that property known as <br />the Kings Crossing Pro~ect, and development agreements and <br />amendments thereto. <br /> <br /> BE IT FURTHER RESOLVED, that the City Manager be, and he <br />hereby is authorized to execute easements to Portsmouth <br />Redevelopment and Housing Authority for drainage for Parcel <br />61A-1 and over and across Parcels 61E, 61F-1 and 61H; to execute <br />a vasual easement for Parcels 61A-1 over and across Parcels 61E, <br />61F-1 and 61H; to execute an easement providing authority for <br />the construction, and maintenance of a retaining wall along the <br />northern boundary of Parcel 61F-1; and to execute an easement of <br />ingress and egress over and across Parcel 61D providing for <br />access to and from commercial development to be established on <br />Parcel 61A-1 adjacent to its southern boundary. <br /> <br /> BE IT FURTHER RESOLVED, that the City Manager be, and he <br />hereby is authorized to execute such other documents, and take <br />such other action(s) as he may deem necessary, and in the best <br />interest of the City of Portsmouth to effect completion of the <br />Kings Crossing Project." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />~ays: None <br /> <br />95-503 Letter from City Manager recommending adoption of a <br />~esolution to support the reconnaissance study of the Elizabeth <br /> iver. <br /> <br /> "The Corps of Engineers has proposed a reconnaissance study <br />of the Elizabeth River. The purpose of this study will be to <br />~ook at existing conditions, problems, needs and options to <br />improve water quality and aesthetics of the river. There as no <br />Cost to the City for this effort. It has been requested by the <br /> orps and by Secretary of Natural Resources Becky Norton Dunlop, <br />however, that area cities endorse this proposal. The attached <br />~esolution, if approved, will become part of the Corps' package <br />Go request federal funding for the study. <br /> <br /> <br />
