322 December 12, 1995 - PUBLIC HEARINGS 95-546 - Public Hearing on a group housing project: GHP-93-04(M) RIVER POINTE NEIGHBORHOOD Group housing project application of Creative Group, Inc., to modify a condition to allow the use of v~nyl siding instead of brick on property to the west of River Pointe Parkway known as the Lanterns. Motion by Mr. Hawks, and seconded by Mr. Pitts, to grant the applicant's request to defer consideration of GHP-93-04(M) to the January 8, 1996 Public Hearing meeting, and was adopted by unanimous vote. Unfinished Business - 95-489 - Use permit: Motion by Mr. Griffin, and seconded by Mr. Martin, to adopt the following resolution, approved at the November 13, 1995 Public Hearing meeting, and was adopted by the following vote: 95-489 (f): "A RESOLUTION GRANTING A USE PEP=MIT FOR THE OPEP, ATION OF AN ADULT RESIDENTIAL CARE FACILITY AT 104 MEDIAN CIRCLE. WHEREAS, Mary Staton and William E. Harrell have made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate an adult residential care facility to be located at 104 Median Circle, Portsmouth, Virginia, as hereinafter- described; and WHEREAS, the applicants and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter- described is sought: (a} Will not adversely affect the health and persons residing or working in the neighborhood of safety of the proposed (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. ~ 2. That Mary Staton and William E. Harre11 are hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of an adult residential care facility on property located at 104 Median Circle, and being more particularly described as:
