3 .3 <br /> <br />December 12, 1995 <br />UP-95-22 <br /> <br /> Beginning at a point 176'± south of the southwest corner of <br />the intersection of Rapidan Street and Greenwood Drive; thence, <br />west 129'~ to a point; thence, south 47'± to a point; thence, in <br />a southeasterly direction 122'± to a point; thence, in a <br />northerly direction 80'± to the point of the beginning. <br /> <br /> 3. That this use permit Ks approved subject to the <br />following conditions: <br /> <br /> (a) Occupancy of the facility shall be limited to no more <br />than five (5) residents, who shall be no less than fifty-five <br />(55) years of age or developmentally disabled. <br /> <br /> (b) Prior to occupancy and at least annually thereafter, <br />the applicants shall request an inspection by the Fire <br />Prevention Bureau, the Public Health Department and the Building <br />Official, shall correct any noted deficiencies, and shall <br />provide notice to the Director of Planning of continuing <br />compliance with this requirement prior to December 31 of each <br />year. <br /> <br /> (c) The applicants shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments, and shall obtain and maintain in effect all <br />necessary licenses and permits. <br /> <br /> (d) The use permit shall be for a period of five years, <br />commencing with the date of adoption of this resolution, and <br />shall expire at the end of that period. An application may be <br />made for a renewal of this use permit at any time within six <br />months preceding its expiration. <br /> <br /> {e) Ail real estate taxes, personal property taxes, <br />business license taxes owed on or in connection with the <br />property shall be timely paid. <br /> <br />and <br /> <br />4. That NOTICE is hereby provided as follows: violation of an] <br />condition of this use permit may serve as a basis for revocatio! <br />by City Council pursuant to the provisions of Section 40-106.2 <br />of the Code of the City of Portsmouth, Virginia (1988) or any <br />successor section." <br /> <br />Ayes: Clemons, Griffin, Martin, Pitts <br />Nays: Hawks, Webb <br />Abstained: Robinett (business interest with owner of property) <br /> <br />- CITY MANAGER'S REPORT - <br /> <br />95-547 Letter from the City Manager recommending adoption of <br />an ordinance governing the collection of Business, Professional <br />and Occupational License (BPOL) taxes. <br /> <br /> "As you know there was a proposal before the 1995 Virginia <br />General Assembly to phase out the Business, Professional and <br />Occupational License (BPOL) tax over a five year period. <br />Although the proposal called for replacement of the lost revenue <br />through an appropriation from the State, there was fear that <br />such funds would eventually be cut if the State encountered a <br />period of fiscal constraint. Fortunately, local authority to <br />impose the BPOL tax was preserved. Portsmouth collects about <br />$4.3 million per year in BPOL tax, one of the largest locally <br />controlled revenues. <br /> <br /> <br />
