February 12, 1996 (e) CA-95-12 CODE AMENDMENT - Request by the City of Portsmouth to amend Section 40-45.6 of the zoning ordinance pertaining to restrictions on parking of commercial vehicles and the parking of mobile construction equipment. The following persons spoke in opposition of the amendment: 1. Haywood Rogerson, Jr., 4124 W. Greenway Court 2. Billy Turner, 3417 Deep Creek Blvd. 3. Thomas Day, 808 Endicotte Road 4. Wes Frye, 3409 Deep Creek Blvd. 5. Marsh Fink, 2700 Victory Blvd. 6. Raymond Hicks, 510 Delham Road 7. Rolandus Gardner, 503 Truman Circle 8. Frank Eates, 141 Monitor Road 9. Alvin Thompson Motion by Mr. Pitts, and seconded by Mr. Clemons, to refer CA-95-12 back to the Planning Con~nission for further options and study, and was adopted by unanimous vote. (f) CA-95-14 CODE AMENDMENT - A proposal to amend the Zoning Ordinance to delete accessory residential dwellings as a permitted use an all zoning districts. Stuart Nelson, 3328 Courtney Road, spoke in opposition to the amendment. Motion by Mr. Martin, and seconded by Mr. Clemons, to defer consideration of CA-95-1~ for 30 days (March 11, 1996), and was adopted by unanimous vote. UNFINISHED BUSINESS - 95-546 Public Hearing on a group housing project: C~{P-93-04 RIVER POINTE NEIGHBORHOOD - Group housing project application of Creative Group, Inc., to modify a condition to allow the use of vinyl siding instead of brick on property to the west of River Pointe Parkway known as the Lanterns, deferred from the December 12, 1995 Regular Meeting. Motion by Mr. Pitts, withdrawal of GHP-93-04(M) unanimous vote. and seconded by Mr. Martin, to accept by the applicant, and was adopted by 96-50 - Public Hearing on rezonings, use permit, and a code amendment: (a) ~.-95-23-B CHURCHLANDNEIGHBORHOOD - Rezoning application of the City of Portsmouth for a comprehensive rezoning of portions of River Pointe and West Norfolk from RM-60-K, RM-75 to RS-75 and M-1-R. Frank Spadea, 620 Village Drive, Suite E, Virginia Beach, spoke in opposition to the rezoning of River Pointe. ElwoOd Isley, Jr., 301 Columbia Street, spoke in opposition to the rezoning of River Pointe. Motion by Mr. Pitts, and seconded by Mr. Clemons, to consider River Pointe and West Norfolk as two separate rezoning items, and was adopted by unanimous vote.
