January 22, 2002 <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That the Portsmouth Redevelopment and Housing Authority is hereby granted <br />a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) for the operation of a restaurant on Victory Boulevard at Victory Crossing <br />Shopping Center, and being more particularly described as: <br /> <br />UP-01-29 <br /> <br /> Beginning at a point 485'+ south of the southeast <br />corner of Victory Boulevard and Airline Boulevard; thence, in a <br />southerly direction 215'+ to a point; thence, in an easterly <br />direction 245.87'+ to a point; thence in a northerly direction <br />196.60'+ to a point; thence, in a westerly direction 263.11'+ to <br />a point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br /> (a) The proposed development shall be constructed in accordance with <br />Trammel Crow Company architectural guidelines (a copy of which is on file in the Office <br />of Planning and Inspections) and the City's signage overlay ordinance. <br /> <br /> (b) Signage shall consist of (i) no more than two ground-mounted signs that <br />do not exceed 35 square feet per sign face and (ii) no more than 194 square feet of wall <br />sign. <br /> <br />(c) Seating capacity within the restaurant shall be limited to 240 seats. <br /> <br /> (d) The days and hours of operation shall be Sunday through Saturday from <br />8:00 a.m. to 12:00 a.m. <br /> <br /> (e) Development shall comply with the submitted site plan, floor plan and <br />building elevations on file in the Office of Planning and Inspections. <br /> <br /> (f) The applicant shall submit a plan for trash handling, storage and removal <br />to the Department of General Services for review and approval. <br /> <br /> (g) The applicant shall observe the City's subdivision process to create the <br />subject parcel. <br /> <br /> (h) The structure shall be inspected annually or as otherwise required by the <br />City's Fire Prevention Bureau, Public Health Department, and Building Official. <br /> <br /> (i) The applicant and any successor in interest shall comply with all <br />applicable codes, ordinances, and regulations of federal, state and local governments <br />and shall obtain and maintain in effect all required licenses and permits. <br /> <br />(j) All taxes in connection with the proposed use shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use oermit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett Whitehurst <br />Nays: None <br /> <br /> <br />
