January 22, 2002 <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That the Portsmouth Redevelopment and Housing Authority is hereby granted <br />a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) for a an industrial launderer facility in the PortCentre Commerce Park, and being <br />more particularly described as: <br /> <br />UP-01-27 <br /> <br />Beginning at the northeast corner of Lincoln Street and <br />Seventh Street; thence, in a northerly direction <br />approximately 450' to a point; thence, in a easterly direction <br />approximately 425' to a point; thence, in a southerly direction <br />approximately 415' to a point; thence, in a westerly direction <br />approximately 565' to a point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br /> (a) A site plan showing parking, circulation, landscaping, and location for <br />garbage storage and collection shall be submitted and approved by the Director of <br />Planning and Inspections prior to applying for or obtaining building permits. <br /> <br /> (b) The exterior facade of the building shall be of brick or other material(s) <br />approved by the Director of Planning and Inspections. <br /> <br /> (c) The applicant or its successor in interest must provide Department of <br />Environmental Quality (DEQ) permits to the Director of Planning and Inspections prior to <br />occupancy. <br /> <br /> (d) The applicant and any successor in interest shall comply with all <br />applicable codes, ordinances, and regulations of federal, state and local governments <br />and shall obtain and maintain in effect all required licenses and permits. <br /> <br />(e) All taxes in connection with the proposed use must be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />01-342(e): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH <br />REDEVELOPMENT AND HOUSING AUTHORITY FOR A RESTAURANT ON <br />VICTORY BOULEVARD AT VICTORY CROSSING SHOPPING CENTER. <br /> <br /> WHEREAS, the Portsmouth Redevelopment and Housing Authority, through its <br />agent, Woolpert, L.L.C., has made application pursuant to Section 40-43.1 of the Code <br />of the City of Portsmouth, Virginia (1988) for the granting of a use permit for the <br />operation of a restaurant on Victory Boulevard at Victory Crossing Shopping Center, <br />Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> <br />
