March 12, 1996 "The developer of Schooner Cove, Section Three, located in the City of Suffolk, adjacent to the Sleepy Hole Golf Course, has asked that the City of Portsmouth adjust the boundary line between our properties so as to provide him enough land to meet Suffolk's requirements for lot size in the area. The developer has previously claimed title to more than the area needed, all lying within the City's boundary line. Under a tentative agreement discussed with him, he would reimburse the City of Portsmouth for its survey costs of $5,500 incurred in establishing the line of the properties as it now is set, and as it will appear if adjusted. I, therefore, recommend the adoption of a resolution which would provide me with the authority to execute such deeds and other documents as may be required to make such boundary line adjustments to the Sleepy Hole Golf Course, as shall be deemed appropriate and in the best interest of the City, and to accept in settlement thereof the su~ of $5,500." Motion by Mr. Robinett, and seconded by Mr. Pitts, adopt the following resolution, and was adopted by the following vote: to "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADJUST A PORTION OF THE EASTERN BOUNDARY OF SLEEPY HOLE GOLF COURSE AND TO ACCEPT THE SUM OF $5,500.00 FOR THAT ADJUSTMENT. WHEREAS a dispute has arisen concerning a portion of the eastern boundary of Sleepy Hole Golf Course; and WHEREAS in resolution of this dispute the City of Portsmouth is willing to adjust this boundary in consideration of reimbursement of surveying costs, in the amount of $5,500.00. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and hereby is, authorized to take such actions and execute and deliver such documents as may be necessary to adjust a portion of the eastern boundary of Sleepy Hole Golf Course as he shall deem appropriate and in the best interest of the City, and that he be, and hereby is, further authorized to accept the sum of $5,500.00 as reimbursement of surveying costs.~ Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: None 96-100 Letter from the City Manager recommending adoption of a resolution to the Virginia Department of Transportation modifying the design of improvements planned for Cedar Lane from High Street West to West Norfolk Road as an Urban Highway Project. "Included in the Virginia Department of Transportation's (VDOT) Six Year Improvement Plan, as an Urban Highway Project, are improvements to Cedar Lane from High Street West to West Norfolk Road. As a result of meetings with residents, the City, and VDOT staff, a feasible compromise was achieved in the proposed design. In order for VDOT to proceed with the necessary design plans and construction, the attached resolution must be adopted.
