March 12, 1996 <br /> <br /> "The developer of Schooner Cove, Section Three, located <br />in the City of Suffolk, adjacent to the Sleepy Hole Golf <br />Course, has asked that the City of Portsmouth adjust the <br />boundary line between our properties so as to provide him <br />enough land to meet Suffolk's requirements for lot size in <br />the area. The developer has previously claimed title to more <br />than the area needed, all lying within the City's boundary <br />line. Under a tentative agreement discussed with him, he <br />would reimburse the City of Portsmouth for its survey costs <br />of $5,500 incurred in establishing the line of the properties <br />as it now is set, and as it will appear if adjusted. <br /> <br /> I, therefore, recommend the adoption of a resolution <br />which would provide me with the authority to execute such <br />deeds and other documents as may be required to make such <br />boundary line adjustments to the Sleepy Hole Golf Course, as <br />shall be deemed appropriate and in the best interest of the <br />City, and to accept in settlement thereof the su~ of $5,500." <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Pitts, <br />adopt the following resolution, and was adopted by the <br />following vote: <br /> <br />to <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADJUST A <br />PORTION OF THE EASTERN BOUNDARY OF SLEEPY HOLE GOLF COURSE <br />AND TO ACCEPT THE SUM OF $5,500.00 FOR THAT ADJUSTMENT. <br /> <br /> WHEREAS a dispute has arisen concerning a portion of the <br />eastern boundary of Sleepy Hole Golf Course; and <br /> <br /> WHEREAS in resolution of this dispute the City of <br />Portsmouth is willing to adjust this boundary in <br />consideration of reimbursement of surveying costs, in the <br />amount of $5,500.00. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the City Manager be, and <br />hereby is, authorized to take such actions and execute and <br />deliver such documents as may be necessary to adjust a <br />portion of the eastern boundary of Sleepy Hole Golf Course as <br />he shall deem appropriate and in the best interest of the <br />City, and that he be, and hereby is, further authorized to <br />accept the sum of $5,500.00 as reimbursement of surveying <br />costs.~ <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />96-100 Letter from the City Manager recommending adoption <br />of a resolution to the Virginia Department of Transportation <br />modifying the design of improvements planned for Cedar Lane <br />from High Street West to West Norfolk Road as an Urban <br />Highway Project. <br /> <br /> "Included in the Virginia Department of Transportation's <br />(VDOT) Six Year Improvement Plan, as an Urban Highway <br />Project, are improvements to Cedar Lane from High Street West <br />to West Norfolk Road. <br /> <br /> As a result of meetings with residents, the City, and <br />VDOT staff, a feasible compromise was achieved in the <br />proposed design. In order for VDOT to proceed with the <br />necessary design plans and construction, the attached <br />resolution must be adopted. <br /> <br /> <br />
