March 12, 1996 <br /> <br /> The Director of Public Works recommends your adoption of <br />the resolution for improvements to Cedar Lane. I concur with <br />the Director of Public Works and recommend your approval of <br />this item." <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Robinett, <br />adopt the following resolution, and was adopted by the <br />following vote: <br /> <br />to <br /> <br /> "A RESOLUTION AUTHORIZING THE VIRGINIA DEPARTMENT OF <br />TRANSPORTATION TO ESTABLISH A PROJECT FOR THE IMPROVEMENT OF <br />CEDAR LANE IN THE CITY OF PORTSMOUTH, VIRGINIA. <br /> <br /> WHEREAS, the City Council of Portsmouth, Virginia <br />desires that the Virginia Department of Transportation (VDOT) <br />establish a project for the improvement of Cedar Lane from <br />High Street West to West Norfolk Road, a length of <br />approximately 1.1 miles. <br /> <br /> WHEREAS, per a resolution adopted by the City Council of <br />Portsmouth on November 14, 1986 plans to accomplish the <br />improvements for a four-lane road were presented at a public <br />hearing on October 19, 1993. <br /> <br /> WHEREAS, as a result of this public hearing it was <br />mutually resolved between project residents and the City of <br />Portsmouth to reduce the scope and impact of the project on <br />the adjacent properties and neighborhoods. <br /> <br /> NOW, THEREFORE, be it resolved that the Council of the <br />City of Portsmouth, Virginia, hereby requests the Virginia <br />Department of Transportation to modify the proposed four-lane <br />improvements as follows: <br /> <br /> Reduce the overall project from four lanes to a <br />three-lane improvement - one lane each direction with a <br />center turn lane. <br /> <br /> The roadway will be built within the existing <br />right-of-way on Cedar Lane. <br /> <br /> There will be no sidewalks or bike lanes constructed on <br />the project. <br /> <br /> The majority of the project will be designed and <br />constructed in order that the adjacent properties will drain <br />to the new roadway, thus eliminating parallel ditches. <br /> <br /> TO reduce the impact on adjacent properties, the project <br />Will be constructed while permitting only one-way traffic <br />during the major portion of the project. <br /> <br /> This shall be programmed with the above modifications by <br />VDOT as an Urban Highway Project. <br /> <br /> BE IT FURTHER RESOLVED, that the City Council of the <br />City of Portsmouth hereby agrees~to pay its share of the <br />total cost for preliminary engineering, right-of-way <br />acquisition and construction of this project in accordance <br />with Section 33.1-44 of the Code of Virginia; and that, if <br />the City of Portsmouth subsequently elects to cancel this <br />project, the City of Portsmouth ~hereby agrees to reimburse <br />the Virginia Department of Transportation for the total <br />amount of costs expended by the Department through the date <br />the Department is notified of Such cancellation, if such <br />reimbursement is not waived by the Commonwealth <br />Transportation Board." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br /> <br />
