March 12, 1996 The Director of Public Works recommends your adoption of the resolution for improvements to Cedar Lane. I concur with the Director of Public Works and recommend your approval of this item." Motion by Mr. Clemons, and seconded by Mr. Robinett, adopt the following resolution, and was adopted by the following vote: to "A RESOLUTION AUTHORIZING THE VIRGINIA DEPARTMENT OF TRANSPORTATION TO ESTABLISH A PROJECT FOR THE IMPROVEMENT OF CEDAR LANE IN THE CITY OF PORTSMOUTH, VIRGINIA. WHEREAS, the City Council of Portsmouth, Virginia desires that the Virginia Department of Transportation (VDOT) establish a project for the improvement of Cedar Lane from High Street West to West Norfolk Road, a length of approximately 1.1 miles. WHEREAS, per a resolution adopted by the City Council of Portsmouth on November 14, 1986 plans to accomplish the improvements for a four-lane road were presented at a public hearing on October 19, 1993. WHEREAS, as a result of this public hearing it was mutually resolved between project residents and the City of Portsmouth to reduce the scope and impact of the project on the adjacent properties and neighborhoods. NOW, THEREFORE, be it resolved that the Council of the City of Portsmouth, Virginia, hereby requests the Virginia Department of Transportation to modify the proposed four-lane improvements as follows: Reduce the overall project from four lanes to a three-lane improvement - one lane each direction with a center turn lane. The roadway will be built within the existing right-of-way on Cedar Lane. There will be no sidewalks or bike lanes constructed on the project. The majority of the project will be designed and constructed in order that the adjacent properties will drain to the new roadway, thus eliminating parallel ditches. TO reduce the impact on adjacent properties, the project Will be constructed while permitting only one-way traffic during the major portion of the project. This shall be programmed with the above modifications by VDOT as an Urban Highway Project. BE IT FURTHER RESOLVED, that the City Council of the City of Portsmouth hereby agrees~to pay its share of the total cost for preliminary engineering, right-of-way acquisition and construction of this project in accordance with Section 33.1-44 of the Code of Virginia; and that, if the City of Portsmouth subsequently elects to cancel this project, the City of Portsmouth ~hereby agrees to reimburse the Virginia Department of Transportation for the total amount of costs expended by the Department through the date the Department is notified of Such cancellation, if such reimbursement is not waived by the Commonwealth Transportation Board."
