March 12,1996 <br /> <br /> "An application has been filed by Portsmouth Partners of <br />Virginia to close portions of Cambridge Street, Wallace <br />Circle, Potomac Avenue, Woodrow Street and a ten foot alley. <br />With the exception of Woodrow Street, the Planning Commission <br />concurs with the viewers' recommendation of approval of the <br />application. In lieu of payment for these areas to be <br />closed, the applicant will be dedicating new streets to the <br />City. <br /> <br /> I, therefore, recommend adoption of an ordinance closing <br />the designated portions of Cambridge Street, Wallace Circle, <br />Potomac Avenue and a ten foot alley, as requested by the <br />applicants." <br /> <br /> Motion by Mr. Martin, and seconded by Mr. Pitts, <br />adopt the following ordinance, and was adopted by the <br />following vote: <br /> <br />to <br /> <br /> "AN ORDINANCE CLOSING A PORTION OF CAMBRIDGE STREET, <br />WALLACE CIRCLE, POTOMAC AVENUE AND A TEN FOOT ALLEY." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />96-98 Letter from the City Manager recommending adoption of <br />an ordinance amending Section 22-805 of the City Code <br />pertaining to set fees for services rendered by tow <br />operators. <br /> <br /> "City Code Section 37-250 allows the City Manager to <br />delegate to the Chief of Police the authority to set fees for <br />services rendered by tow operators. Accordingly, daytime <br />tows are set at $50, while night and holiday tows are set at <br />$55. <br /> <br /> City Code Section 22-805 is in conflict with 37-250 <br />since it requires the payment of a towing fee of $40 for <br />vehicles which are being retrieved from the City Compound. <br />It has been recommended that Section 22-805 be enacted to <br />reflect payment of fees in accordance with the rates set in <br />37-250, rather than listing specific amounts. <br /> <br /> The adoption of this ordinance will eliminate any <br />conflicting language and fees between City Code sections <br />22-805 and 37-250. I, therefore, recommend your approval of <br />this code change." <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Griffin, <br />adopt the following ordinance, and was adopted by the <br />following vote: <br /> <br />to <br /> <br /> "AM ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION <br />22-805 THEREOF PERTAINING TO REDEMPTION OF TOWED VEHICLES." <br /> <br />Ayes: Griffin, HaWks, Martin, Pitts, Robinett, Webb <br />Nays: Clemons ~ <br /> <br />96-99 - Letter from the City Manager recommending adoption of <br />a resolution giving the City Manager authority to execute <br />deeds and other documents necessary to adjust the boundary <br />line of the Sleepy Hole Golf Course, and to accept the sum of <br />$5,500 in settlement. <br /> <br /> <br />
