March 12,1996 "An application has been filed by Portsmouth Partners of Virginia to close portions of Cambridge Street, Wallace Circle, Potomac Avenue, Woodrow Street and a ten foot alley. With the exception of Woodrow Street, the Planning Commission concurs with the viewers' recommendation of approval of the application. In lieu of payment for these areas to be closed, the applicant will be dedicating new streets to the City. I, therefore, recommend adoption of an ordinance closing the designated portions of Cambridge Street, Wallace Circle, Potomac Avenue and a ten foot alley, as requested by the applicants." Motion by Mr. Martin, and seconded by Mr. Pitts, adopt the following ordinance, and was adopted by the following vote: to "AN ORDINANCE CLOSING A PORTION OF CAMBRIDGE STREET, WALLACE CIRCLE, POTOMAC AVENUE AND A TEN FOOT ALLEY." Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: None 96-98 Letter from the City Manager recommending adoption of an ordinance amending Section 22-805 of the City Code pertaining to set fees for services rendered by tow operators. "City Code Section 37-250 allows the City Manager to delegate to the Chief of Police the authority to set fees for services rendered by tow operators. Accordingly, daytime tows are set at $50, while night and holiday tows are set at $55. City Code Section 22-805 is in conflict with 37-250 since it requires the payment of a towing fee of $40 for vehicles which are being retrieved from the City Compound. It has been recommended that Section 22-805 be enacted to reflect payment of fees in accordance with the rates set in 37-250, rather than listing specific amounts. The adoption of this ordinance will eliminate any conflicting language and fees between City Code sections 22-805 and 37-250. I, therefore, recommend your approval of this code change." Motion by Mr. Pitts, and seconded by Mr. Griffin, adopt the following ordinance, and was adopted by the following vote: to "AM ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 22-805 THEREOF PERTAINING TO REDEMPTION OF TOWED VEHICLES." Ayes: Griffin, HaWks, Martin, Pitts, Robinett, Webb Nays: Clemons ~ 96-99 - Letter from the City Manager recommending adoption of a resolution giving the City Manager authority to execute deeds and other documents necessary to adjust the boundary line of the Sleepy Hole Golf Course, and to accept the sum of $5,500 in settlement.
