~arch 12th, 1940 <br /> <br /> mat!on and advertising matter is to be distributed ~etting forth <br /> the advantages and resources of the City of Portsmouth. <br /> THIRD: To have prepared and printed from time to time dur - <br /> ing the next five years certain folders, cards an~ other litera - <br /> ture showing the advantages and resources of the City of Portsmouth, <br /> and to~ distribute the same in suc~ manner that the advantages and <br /> r~sou.rces of the City ~ill be well advertised. <br /> FOURTH: To cause to be incorporated in s~y lease executed <br />~,~th a lessee and/or operator of said hotel a provision requiring <br />the said lessee and/or operator to include in their advertising <br />program dat~ and information advertising the resources and advan- <br />tages of the City of Portsmouth, Virginia, from the day said hotel <br />is open for use by the public, or sooner, and the five (5) succes- <br />sive years thereafter. <br /> It is further agreed between the parties hereto that: <br /> (a) The f~oor space above referred to shall be three and <br />one-~lf (3½) feet square and said floor space shall be in a con <br />spicuous place in the lobby of said hotel to be agreed upon by <br />the parties hereto after completion of said hotel, and the same <br />shall be used e~clusively for giving information and for advertis- <br />ing ~he advantages and resources of said City and for advertising <br />the Portsmouth-Norfolk County Ferries and the said City may at <br />any time it may so desire place an attendant therein for advertising <br />RU/'pOSSS, <br /> (b) Should the party of the first part fail to erect a hotel <br />in the City of Portsmouth, Virginia, within ~h~ee (3) zears from <br />the date hereof, and set apart said floor space, or refuse to carry <br />out its part of this contract then the money paid under thi~ con - <br />trac~ shall be refunded ~o the party of the second part, and this <br />contract shall become void. <br /> <br />WITNESS TME FOLLOWING SIGNATURES AND SEALS: <br /> <br />Attest: <br /> <br />Secretary <br /> <br /> PORTSMOUTH HOTEL CORPORATION <br /> <br />By <br /> President."
