<br /> WHEREAS, the City has not been able to purchase the
<br />property described herein, necessary to the project, because
<br />the owner thereof and the City have not been able to agree
<br />upon the price to be paid therefor; and
<br />
<br /> WHEREAS, the advancement of the work and the use of the
<br />property will be unreasonably delayed if said property is not
<br />made available for the project as soon as possible.
<br />
<br /> NOW, THEREFORE BE IT RESOLVED By the Council of the City
<br />of Portsmouth, Virginia:
<br />
<br /> That the City Attorney be, and he hereby is, directed to
<br />institute eminent domain proceedings against the
<br />hereinafter-described property situate in the City of
<br />Portsmouth, Virginia, for the purpose of acquiring the fee
<br />simple title thereto pursuant to Sections 2.06, 2.07 and 2.08
<br />of the Charter of the City of Portsmouth, Virginia, as
<br />amended, and to deposit with the clerk of the Circuit Court
<br />of the City of Portsmouth as provided by law, the sum of
<br />$500.00 to be paid pursuant to order of the Court specified
<br />to compensate the owner of the property described as follows,
<br />to-wit:

<br /> All that certain piece or parcel of land, lying and
<br />being in the City of Portsmouth, Virginia, being denoted as
<br />Brinkley Acquisition Area = 120.0 S. F. (0.G028 AC.) of that
<br />parcel shown or designated as "Now or Formerly Brinkley
<br />Trailer Court Tax Map 385, Parcel 2 (D. B. 955, Pg. 380)" on
<br />that certain plat entitled "Plat Showing Property To Be
<br />Acquired By The City Of Portsmouth, Virginia For Right Of Way
<br />Purposes, Portsmouth, Virginia", made by C. Allan Bamforth,
<br />Jr., Engineer-Surveyor, Ltd.

<br /> The name of the property owner is Brinkley Trailer
<br />Court, Inc."
<br />
<br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb
<br />Nays: None
<br />
<br /> Motion by Mr. Robinett, and seconded by Mr. Clemons, to
<br /> adopt the following resolution, and was adopted by the
<br /> following vote:

<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN
<br /> PROPERTY OWNED BY THOMAS BENVENUTO UNDER EMINENT DOMAIN
<br /> PROCEEDINGS PURSUANT TO THE CHARTER OF THE CITY OF
<br /> PORTSMOUTH, VIRGINIA, FOR THE WIDENING OF GEORGE WASHINGTON
<br /> HIGHWAY.
<br />
<br /> WHEREAS, the Council of the City of Portsmouth has
<br />determined it to be in the public interest to widen George
<br />Washington Highway in the area of the entrance into new Navy
<br />housing erected to the south of said Highway; and
<br />
<br /> WHEREAS, the City has n0t been able to purchase the
<br />property described herein~ necessary to the project, because
<br />the owner thereof and the City have not been able to agree
<br />upon the price to be paid therefore; and
<br />
<br /> WHEREAS, the advancement of the work and the use of the
<br />property will be unreasonably delayed if said property is not
<br />made available for the project as soon,as possible.

<br /> NOW, THEREFORE~ BE IT RESOLVED By the Council of the
<br />City of Portsmouth~ Virginia:
