<br /> The Farm Security Administration is- engaged in a program of providing
<br />Ah~+u~n~g~fo~r~d.e~f~en~s.~._work~e~s ~with~u~? f~amilies. Tne~have~m~de ~r~angements with the Housing
<br />--~-~ ~ ~ ~,y o~ ~or-ssmou~, ~o use a per,men cz ~eir land, north of the A.& D. Rail-
<br />road tracks and adjacent to ~the Dale Homes project. I recommend that the requests contained
<br />in this letter be approved, under the following conditions:

<br /> 1. That the City of Portsmouth will not be put to any ex -
<br /> pense in connection ~th these requests.
<br /> 2.That the ~arm Security Administration will pay for all
<br /> wa~er, at the regular established rates.
<br /> 3~ That the City of Portsmouth will not furnish any se~r -
<br /> vices, including sewage pumping costs, to this project,
<br /> withouS compensation; said services to be compensated
<br /> for on a basis cf oosS similar to the arrangement we
<br /> now have with the Housing Authority.

<br /> I am informed that the Farm SeCUrity Administration, under its autho -
<br />rity, must make agreements separately for e ach type of service.
<br /> I respectfully request that the City Manager be authorized to negotiate
<br />end conclude such agreements, when sufficient data is available."

<br /> 3rd - "In order for the flood lights to be established at the dam at Lake Ca-
<br />boon, it became necessary for the Virginia Electric & Power Company to place a pole on the
<br />perry of the Oity. The Company requested a right of way agreement and ~he City Attorney has
<br />prepared an agreement which I recommend will be signed by the properi, eity officials. The
<br />agreement is submitted herewith."

<br /> "THIS'AGREENENT, Nade t~he 27th day of May, 1941, between the City of Ports -
<br />mouth, a municipal corporation of the State of Virginia, hereinafter called "Owner" and the
<br />Virginia Electric & Power Company, a corporation, hereinafter.called "Oompany"
<br /> WITNESSETH: That in consideration of the sum of One Dollar and the benefits
<br />to be received, the Owner grants to the Company, its successors and s~signs the right, Privi-
<br />lege and easement of right of way to construct, operate and maintain one pole and wires le~d-
<br />ing thereto for the transmission and distribution of electricity over, upon and across the land
<br />of the Owner from State Highway Number 604 to a point distant approximately forty feet from
<br />said hi ghway near the road leading to the house at the dam of Lake Cahoon, in Nansemond County,
<br />Virginia, and shown upon the plan marked 2252 A, hereto attached and made a part of this agree-
<br />merit, and on which the center line of~said right of way is shown in red lines, ~th the~right
<br />and privilege to string wires, ane make attachments~ ground connections and use equipment and
<br />accessories in connection ~therewith.
<br /> It is agreed between the parties hereto that should the locati~ of said pole
<br />interfere with the future development and use of the land the Company will re-locate the pole
<br />in a convenient location on the land; that the poles, wires, attachments, equipment and acces -
<br />series erected hereunder shall De and remain the property of the Company; that no charge shall
<br />be made, at any time, for the use of the property occupied by the company, or for the privilege
<br />of constructing~ maintaining,and operating said pole and lines; that the Company, its agents,
<br />and employees shall, at al! times, have full and free in~ress to and egress from and over the
<br />said property of the O~*ner, in order to construct and efficiently maintain said lines and ap -
<br />purtensnc~s, with the right to inspect, rebuild, repair, improve, re-locate along the route de-
<br />scribed, remove, make ~xtensions or addiSions thereto, and make such changes, alterations and
<br />substitmtions in said lines, wires, poles, attachments, equipment, and a~cessories, as the
<br />9ompany m~a~ fro~time.~t~.tim~ deem advisable, or expedient, including the right to increase or
<br />~ecrease ~ae numoer of~ires, with the further right to trim, cu~ and keep clear all trees,
<br />limbs, and.undergrowth and other obstructions along said lines or ad~acent~ thereto, ~*~e

<br />all the rights and p~ivi!eges reasomably~ necessary or-convenient for the full enjoyment or
<br />for any of the aforesaid purposes, of the rights, and nrivileges hereby granted.
<br /> The Owner covenants ~h~t it h~s the risht to convey the said easement; that
<br />the Company shall have quiet and peaceable possession, use, and enjoyment of the said easement,
<br />and that the Owner will execute such further assurance of the said easement as may be requisite.
