June 25, 1996 <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Griffin, to <br />suspend the rules of order to consider agenda items 96-200 <br />e-g as one item, and was adopted by unanimous vote. <br /> <br /> Motion by Mr. Martin, and seconded by Mr. Griffin, to <br />adopt the following resolutions and ordinance, approved on <br />first reading at the Public Hearing meeting on June 11, 1996, <br />and was adopted by the following vote: <br /> <br />96-200 (e): <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO GREATER MT. <br />FOR THE CONSTRUCTION AND OPERATION OF A CHURCH AT <br />CREEK BOULEVARD. <br /> <br />ZION CHURCH <br />3100 DEEP <br /> <br /> WHEREAS, Greater Mt. Zion Church has made application <br />pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouth, Virginia (1988) for the granting of a use permit <br />to rebuild and operate a church at 3100 Deep Creek Boulevard, <br />Portsmouth, Virglnia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicants and the Planning Director have <br />done all things required to be done an connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Co~unission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit hereinafter- <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of <br />persons residing or working in the neighborhood of the <br />proposed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements in the <br />neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to <br />insure compatibility with surrounding uses; <br /> <br /> (d) Will be a pro]ect that will be developed according <br />to a plan for parking, driveways, and curb cuts which will <br />provide for safe and convenient traffic movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City <br />of Portsmouth Zoning Ordinance. <br /> <br /> 2. That Greater Mt. Zion Church is hereby granted a use <br />permit pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouth, Virginia (1988) for the construction and <br />operation of a church on property located at 3100 Deep Creek <br />Boulevard, and being more particularly described as: <br /> <br />UP-96-04 <br /> <br />Beginning at the northwest corner of the intersection of Deep <br />Creek Boulevard and Bagley Street; thence, west 120'± to a <br />point; thence, north 100'± to a point; thence; east 120'+ to <br />a point; thence; south 100'~ the point of the beginning. <br /> <br /> <br />
