June 25, 1996 NOW, THEREFORE, BE IT RESOLVED by the Council of the City of PortsmoUth, Virginia= 1. That the use for which the permit hereinafter- described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neigb-borhood of the proposed use; (b) Will not he detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic move~ent; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Bishops Green, L.L.C., is hereby granted a use permit pursuant to Sectioni40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the construction and operation of a wastewater pumping station on a portion of Phase Two of the SubdivisiOn of Bishops Green, and being more particularly described as: UP-96-03 Beginning at a point approximately 1047~ feet from the northeast intersection of Sturbridge Way (proposed) and Sedgewyck Circle (proposed) thence southwest approximately 12 feet along western right-of-way line of Sedgewyck Circle to a point; thence northwest 203 feet to a point; thence northeast 56 feet to a point; thence sOutheast 34.88 feet to a point; thence southeast 18.08 feet to a point; thence southwest 44 feet to a point; thence southeast 150 feet to the point of beginning. 3. That this use permit is approved subject to the following conditionS: (a) The facility may only be constructed at the location shown on Exhibit A, attached hereto and made a part hereof; (b) The applicant shall install and maintain the landscaping shown on Exhibit C, ~attached hereto and made a part hereof; (c) The facility shall be developed in accordance with the site plan and elevations shown on Exhibits B, D1 and D2, attached hereto and :made a part hereof; (d) In the construction, maintenance and operation of the facility, the appliciants shall comply with all applicable codes, ordinances and regulations of federal, state and local governments, and shall obtain and maintain in effect all necessary licenses a~d permits. 4. REVOCATION iOF PERMIT: Violation of any condition of this use permit may iserve as a basis for revocation of the permit by the City Ciouncil."
