June 25, 1996 <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) Sanctuary capacity shall be limited to 36 seats. <br /> <br />(b) Prior to construction, a site plan provided for (1) <br />adequate parking for the permitted seating and (2) <br />landscaping must be submitted to and approved by the City's <br />Engineering Department. <br /> <br />(c) Prior tO construction, all building plans must be <br />submitted to and approved by the Building Official. <br /> <br />(d) Prior to construction, the applicant must obtain all <br />necessary approvals from the Commission of Architectural <br />Review and the Board of Zoning Appeals andmust othez-wise <br />comply with all applicable codes, ordinances and regulations <br />of federal, state and local governments, and shall obtain and <br />maintain in effect all necessary licenses and permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above <br />conditions may serve as a basis for revocation ofthe use <br />permit by the City Council." <br /> <br />96-200(f): <br /> <br /> "ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 40-43.4 <br />AND TABLE 40-43.1-2 THEREOF, PERTAINING TO HOTELS AND MOTELS <br />IN COMMERCIAL C-2 AND WATERFRONT W-1 ZONING DISTRICTS." <br /> <br />96-200(g): <br /> <br /> "A RESOLUTION APPROVING AND ADOPTING AN AMENDMENT OF THE <br />ENVIRONMENTAL COMPONENT OF THE COMPREHENSIVE PLAN FOR THE <br />CITY OF PORTSMOUTH. <br /> <br />WHEREAS, the Council of the City of Portsmouth, <br />Virginia, on July 11, 1989, adopted a Comprehensive Plan, <br />(CP-89-1), for the physical development of the territory <br />within the City; and <br /> <br /> WHEREAS, the Planning Commission, after notice and <br />public hearing, as required by Article IV of Chapter 11 of <br />Title 15.1 of the Code of Virginia, 1950, as amended, has <br />recommended that the Environmental Component of said <br />Comprehensive Plan be amended as set forth in a document <br />entitled "Environmental Component of the Comprehensive Plan;" <br />and <br /> <br /> WHEREAS, the Council of the City of Portsmouth has held <br />a public hearing, after notice as required by law, and has <br />considered the proposed amendment to the Comprehensive Plan. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, that the environmental component of the <br />City's Comprehensive Plan for the City of Portsmouth, <br />Virginia, designated as CP-89-1 be, and hereby is, amended as <br />set out in the document entitled "Environmental Component of <br />the Comprehensive Plan." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett <br />Nays: None <br /> <br /> <br />
