June 25, 1996 96-200(c): "A RESOLUTION AMENDINGA USE.PERMIT PREVIOUSLY GRANTED TO sANDRA PINNOCK FOR THE OPERATION OF A CHILD DAY CARE FACILITY AT 1220 CAVALIER BOULEVARD. WHEREAS, on May 25, 1993, the Council of the City of Portsmouth, Virginia, granted Use Permit UP-93-03 to Sandra Pinnock to operate a child day care facility at 1220 Cavalier Boulevard, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, said Sandra Pinnock has now made application to amend the conditions of the use permit previously granted; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, thePlanning Commission has recommended the amendment of the conditions of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter- described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That, pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988), the application of Sandra Pinnock to amend the conditions for the operation of a child day care facility on property located at 1220 Cavalier Boulevard is hereby granted, said property being more particularly described as: UP-93-03-M Beginning on the west right-of-way of Cavalier Boulevard 170' more or less north from its intersection with the north right-of-way of Tazewell Street; thence east 150' to the west right-of-way of Cavalier Boulevard; thence south along said right-of-way 150' to the point of beginning. 3. That the application of Sandra Pinnock is granted subject to the following conditions: (a) Occupancy of the facility shall be limited to a total of 86 children. No more than 65 children between the ages of 2-1/2 and 12 years of age may occupy the facility at any time. No more than 21 children under the age of 2-1/2 years of age may occupy the facility at any time.
