June 25, 1996 <br /> <br /> 2. That a group housing-use permit for the <br />construction of 45 detached single-family condominiums <br />located at River Pointe is hereby granted to River Pointe <br />Development Associates, L.L.C., subject to the following <br />terms and conditions: <br /> <br />(a) The group housing project shall be limited to 45 <br />detached single-family condominiums, as per the attached site <br />plan, identified as Exhibit A and made a part hereof. <br /> <br />(b) A landscaping plan shall be submitted to the Planning <br />Department for review and approval and must show the <br />landscaping treatment, including tree placement adjacent to <br />the exposed side elevations, for Units 1, 25, 27, 39, 40, and <br />45, including the location and screening of mailboxes. <br /> <br />(c) In addition to any buyer-selected brick facade options <br />added to other units, one-story brick facades shall be <br />provided on Units 1, 6, 7, 16, 17, 25, 27, 39, 40, and 45 as <br />shown on Exhibit A. Substitution of an alternate unit for <br />any unit identified in Exhibit A must be approved in advance <br />by the Planning Director. <br /> <br />(d) Any development in addition to the dwelling units, such <br />as sheds or decks, as to Units 5-17, which would be located <br />in the Chesapeake Bay Preservation areas must be approved an <br />advance in accordance with Chapter 9.1 of the Code of the <br />City of Portsmouth, Virginia, or any successor thereto <br />(Chesapeake Bay Preservation Area Overlay District <br />Ordinance). <br /> <br />(e) Any revisions to the site plan, landscaping plan or <br />approved elevations made throughout the group housing permit <br />application process, including changes made pursuant to City <br />Council request, must be submitted to the Planning Department <br />for review and approval prior to application for or issuance <br />of any building permits. <br /> <br />(f) The applicant shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments, and shall obtain and maintain in effect all <br />necessary permits. <br /> <br /> 3. EXPIRATION OF PERMIT: Pursuant to Section 40-115 of <br />the Code of the City of Portsmouth, Virginia (1988), the <br />group housing use permit shall expire if the applicant fails <br />to apply for all building permits for the entire project <br />within one year of the adoption of this resolution or if he <br />fails to secure an <br />extension of the expiration deadline as provided in said Code <br />section. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above <br />conditions may serve as grounds for revocation of the permit <br />by the City Council." <br /> <br />Ayes: Clemons, Griffin, HawkS; Martin, Pitts, Robinett <br />Nays: None <br /> <br /> Motion by Mr. Martin, and seconded by Mr. Robinett, to <br />adopt the following resolution, approved on first reading at <br />the Public Hearing meeting on June 11, 1996, and was adopted <br />by the following vote: <br /> <br /> <br />
