That this use permit is approved subject to the <br />following condition: <br /> <br /> Use of the property shall be limited to the operation of <br />a retail clothing store (boutique). <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above <br />conditions may serve as grounds for revocation of the use <br />permit by the City Council." <br /> <br />Ayes: Berm, Clemons, Griffin, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />96-235 - Rezoning: <br /> <br />(a) Ordinance granting the rezoning application of the City <br />of Portsmouth of a comprehensive rezoning of portions of Port <br />Norfolk and Mount Hermon neighborhood from Commercial (C-2) <br />to Industrial (M-l). (Z-96-05) (First Reading Vote 6-0-1) <br /> Motion by Mr. Pitts, and seconded by Mr. Martin, to <br />defer consideration of the rezoning to the August 13, 1996 <br />Regular City Council meeting, and was adopted by a vote of <br />6-0-1 (Robinett-Abstained due to ownership of property by <br />employer). <br /> <br />- CITY MANAGER'S REPORT - <br /> <br />96-261 - Letter from the City Manager recommending adoption <br />of an ordinance to amend and reordain Section 35-372 of the <br />City Code pertaining to bingo. <br /> <br /> "Presently, bingo operators in the City charge a fee for <br />both admissions and use of bingo cards. Admission taxes <br />collected by the Commissioner of the Revenue have <br />historically been levied on the admissions fee only. The <br />change requested by the Commissioner of the Revenue would <br />clarify the City Code with respect to the basis of the bingo <br />tax. The proposed change would establish five dollars as the <br />amount of the total fee subjected to admission tax if the <br />admission fee is not specifically identified. This action is <br />revenue neutral. <br /> <br /> I, therefore, present for your consideration the' <br />proposed code change to clarify the code with respect to <br />bingo admissions tax." <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Pitts, <br />adopt the following ordinance, and was adopted by the <br />following vote: <br /> <br />to <br /> <br /> "AN ORDINANCE TO AMEND AND REORDAIN SECTION 35-372 <br />THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), <br />PERTAINING TO BINGO ADMISSION TAXES." <br /> <br />OF <br /> <br />Ayes: Berm, Clemons, <br />Nays: None <br />Abstained: Martin - <br /> <br /> Griffin, Pitts, Robinett, Holley <br /> <br />Previously represent bingo establishments <br /> <br />96-262 - Letter from the City Manager recommending adoption <br />of a resolution conveying City-owned property in the 3100 <br />block of Ballard Avenue to the Portsmouth Redevelopment and <br />Housing Authority for sale to a private business. <br /> <br /> <br />
