jul%, 23, 1996 <br /> <br />(g) The applicants shall ope~ate~the inn in accordance with <br />Section 40-52.7 of the Zoning Ordinance and all applicable <br />codes, ordinances and regulations of federal, state and local <br />governments, and shall obtain and maintain in effect all <br />necessary licenses and permits. <br /> <br />(h) The use permit is issued to Douglas and Shelia Gregory <br />and is not transferable. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above <br />conditions may serve as grounds for revocation of the use <br />permit by the City Council." <br /> <br />96-235 (e): <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF <br />A RETAIL STORE AT 233 HIGH STREET. <br /> <br /> WHEREAS, Malbon Bell, L.L.C., has made application <br />pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouth, Virginia (1988) for the granting of a use permit <br />to operate a retail store to be located at 233 High Street, <br />Portsmouth, Virginia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1o That the use for which ~the permit hereinafter- <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of <br />persons residing or working in the neighbOrhoOd of the <br />proposed use; <br /> <br /> (b) Will not 'be detrimental to the public use or <br />injurious to the property or improvements in the <br />neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to <br />insure compatibility with surrounding uses; <br /> <br /> (d) Will be a project that will be developed according <br />to a plan for parking, driveways, and curb cuts which will <br />provide for safe and convenient traffic movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City <br />of Portsmouth Zoning Ordinance. <br /> <br /> 2. That Malbon Bell, L.L.C., is hereby granted a use <br />permit pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouth, Virginia (1988) for the operation of a retail <br />store on property located at 233 High Street, and being more <br />particularly described as: <br /> <br />UP-96-!11 <br /> <br />Beginning at a point 278.20'~ west of the southwest corner of <br />High Street and Crawford Street; thence, west 74.66'± to a <br />point; thence, south 113'± to a point; thence, east 74.24'± <br />to a point; thence, 113'± to the point of the beginning. <br /> <br /> <br />
