jul%, 23, 1996 (g) The applicants shall ope~ate~the inn in accordance with Section 40-52.7 of the Zoning Ordinance and all applicable codes, ordinances and regulations of federal, state and local governments, and shall obtain and maintain in effect all necessary licenses and permits. (h) The use permit is issued to Douglas and Shelia Gregory and is not transferable. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 96-235 (e): "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A RETAIL STORE AT 233 HIGH STREET. WHEREAS, Malbon Bell, L.L.C., has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a retail store to be located at 233 High Street, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1o That the use for which ~the permit hereinafter- described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighbOrhoOd of the proposed use; (b) Will not 'be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Malbon Bell, L.L.C., is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a retail store on property located at 233 High Street, and being more particularly described as: UP-96-!11 Beginning at a point 278.20'~ west of the southwest corner of High Street and Crawford Street; thence, west 74.66'± to a point; thence, south 113'± to a point; thence, east 74.24'± to a point; thence, 113'± to the point of the beginning.
