5-13 <br /> <br /> July 23, 1996 <br /> <br /> (a) Wi!l ~ot a~er~ely affect the health and safety of <br />persons reS d 0rWo=ki g in the neig orhood of the <br />proposed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements in the <br />neighborhood; <br /> <br /> (c) Is compatible with and will not adversely affect or <br />be materially detrimental to adjacent uses, residents, <br />buildings, structures, or natural resources; <br /> <br /> (d) Will be provided with sufficient landscaping to <br />insure compatibility with surrounding uses; <br /> <br /> (e) Will be a project that will be developed according <br />to a plan for parking, driveways, and curb cuts which will <br />provide for safe and convenient traffic movement; and <br /> <br /> (f) Will be in accordance with the purposes of the City <br />of Portsmouth Zoning Ordinance. <br /> <br /> 2. That Douglas and Shelia Gregory are hereby granted a <br />use permit pursuant to Section 40-43.1 of the Code of the <br />City of Portsmouth, Virginia (1988) for the operation of a <br />bed and breakfast inn to be located at 314 Court Street, <br />being more particularly described as: <br /> <br />UP-96-06 <br /> <br /> Beginning at a point approximately 870 feet from the <br />northwestern intersection of Court Street and North Street <br />thence north 30 feet along the western right-of-way line of <br />Court Street to a point; thence west 113 feet to a point; <br />thence south 30 feet to a point; thence east 113 feet to the <br />point of beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) Unless otherwise provided herein, the inn shall be <br />operated in accordance with a letter dated April 23, 1996, <br />from Sheila A. Gregory to the Planning Commission, identified <br />as Exhibit A and made a part hereof. <br /> <br />(b) No more than five bedrooms shall be used for the inn. <br /> <br />(c) The applicants shall keep a guest register of all guests <br />and shall make the register available for inspection to the <br />City of Portsmouth at any time. <br /> <br />(d) Only overnight guests may be served meals or <br />refreshments. Commercial meal service may not be offered to <br />non-overnight inn guests. <br /> <br />(e) No additions or alterations to the exterior of the <br />structure shall be made unless approved by the Commission of <br />Architectural Review. <br /> <br />(f) Prior to issuance of the occupancy permit, the <br />applicants shall provide seven off-street parking spaces <br />within 300 feet of the inn, either through agreement with the <br />Traffic Engineer or by other means in accordance with the <br />City Code. <br /> <br /> <br />
