July 23, 1996 <br /> <br />(b) The style of the tower and the type of materials used to <br />construct the tower shall be identical to the existing GTE <br />tower and building in Cradock. <br /> <br />(c) The exterior of the tower shall be unpainted galvanized <br />or painted a color approved by the City Planning Commission. <br />No other marking or lighting shall be used on the tower <br />unless required by the Federal Aviation Administration (FAA). <br /> <br />(d) The use permit shall become void if the tower becomes <br />unused or obsolete. In the event that the permit becomes <br />void, the tower must be removed within twelve months. <br /> <br />(e) No signs or advertising may be attached to the tower. <br /> <br />(f) Prior to the issuance of a building permit, the <br />applicant must submit plans to the Building Official which <br />certify that the tower meets all requirements of the Building <br />Code and EIA-22E, Structural Standards for Steel Antenna <br />Towers and Antenna Supporting Structures. <br /> <br />(g) Prior to application for a building permit, written <br />statements from the FAA and the Federal Communication <br />Commission (FCC) stating that the proposed tower is <br />consistent with or exempt from their regulations must be <br />delivered to the Director of Planning. <br /> <br />(h) The east and west sides of the leased area must be <br />screened with a solid wooden fence or with vegetation <br />approved by the Director of Planning. <br /> <br />(i) Prior to application for a use permit, the applicant <br />must provide the Director of Planning with a statement from a <br />certified engineer that the non-ionizing electromagnetic <br />radiation (NIER) emitted from the proposed facility will not <br />result in ground level exposure exceeding standards <br />established by any U.S. government agency or the American <br />Standards Institute. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above <br />conditions may serve as grounds for revocation of the use <br />permit by the City Council." <br /> <br />96-235 (d): <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF <br />A BED AND BREAKFAST INN AT 314 COURT STREET. <br /> <br /> WHEREAS, Douglas and Sheila Gregory have made <br />application pursuant to Section 40-43.1 of the Code of the <br />City of Portsmouth, Virginia (1988) for the granting of a use <br />permit to operate a bed and breakfast inn to be located at <br />314 Court Street, Portsmouth, Virginia, as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicants and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1o That the use for which the permit hereinafter- <br />described is sought: <br /> <br /> <br />
