96-235 (c): <br /> <br />July 23, 1996 <br /> <br />51t <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT FOR THECONSTRUCTiON <br />AND OPERATION OF A COMMUNICATION TOWER AT 300 PORT CENTRE <br />PARKWAYs. <br /> <br /> WHEREAS, GTE-Mobilnet has made application pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, <br />Virginia (1988) for the granting of a use permit to construct <br />and operate a communication tower (S.I.C, 48)to be located <br />at 300 PortCentre Parkway, Portsmouth, Virginia, as <br />hereinafter- described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit hereinafter- <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and~safety of <br />persons residing or working in theneigb_borhood of the <br />proposed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements in the <br />neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to <br />insure compatibility with surrounding uses; <br /> <br /> (d) Will be a project that will be developed according <br />to a plan for parking, driveways, and curb cuts which will <br />provide for safe and convenient traffic movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City <br />of Portsmouth Zoning Ordinance. <br /> <br /> 2. That GTE-Mobilnet is hereby granted a use permit <br />pursuant to Section 40-43.I of the Code of the City of <br />Portsmouth, Virginia (1988) for the construction and <br />operation of a communication tower on property located at 300 <br />PortCentre Parkway, and being more particularly described as: <br /> <br />uP-96-os <br /> <br /> Beginning at a point at the northwest corner of <br />PortCentre Parkway and Henry Street; thence, west <br />approximately 420 feet to intersection of the western edge of <br />a closed portion of Fifth Street and Henry Street; thence, <br />north approximately 544 feet to the southern right-of-way <br />line of WAVY Street; thence, east approximately 420 feet to <br />the western right-of-way line of PortCentre Commerce Park; <br />thence, south approximately 545 feet to the point of <br />beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) The tower shall not exceed 125 feet in height and shall <br />be equipped to accommodate at least one additional user. <br /> <br /> <br />
