96-235 (c): July 23, 1996 51t "A RESOLUTION GRANTING A USE PERMIT FOR THECONSTRUCTiON AND OPERATION OF A COMMUNICATION TOWER AT 300 PORT CENTRE PARKWAYs. WHEREAS, GTE-Mobilnet has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to construct and operate a communication tower (S.I.C, 48)to be located at 300 PortCentre Parkway, Portsmouth, Virginia, as hereinafter- described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter- described is sought: (a) Will not adversely affect the health and~safety of persons residing or working in theneigb_borhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That GTE-Mobilnet is hereby granted a use permit pursuant to Section 40-43.I of the Code of the City of Portsmouth, Virginia (1988) for the construction and operation of a communication tower on property located at 300 PortCentre Parkway, and being more particularly described as: uP-96-os Beginning at a point at the northwest corner of PortCentre Parkway and Henry Street; thence, west approximately 420 feet to intersection of the western edge of a closed portion of Fifth Street and Henry Street; thence, north approximately 544 feet to the southern right-of-way line of WAVY Street; thence, east approximately 420 feet to the western right-of-way line of PortCentre Commerce Park; thence, south approximately 545 feet to the point of beginning. 3. That this use permit is approved subject to the following conditions: (a) The tower shall not exceed 125 feet in height and shall be equipped to accommodate at least one additional user.
