organized aud doinE business -~uder the laws of the Commonwealth of Virginia, hereinafter some- <br />tLmes called the ~0ompanY", party of the second part: <br /> ~HEREAS, the City has agreed that d~ing the termof.tdais agreement it <br />will purchase from the. 0ompany and the Company has agreed that it will furnzsh to the Oityall <br />of the electrical requirements of the City for municipal purposes and the parties hereto desir~ <br />to set fo~h in this agreement the te~ms ~ud conditions ~u~der which such electric energy shall <br />be purchased ~nd supplied; <br /> NC~', T~EREFOEE, THIS AGREEME~T V~ITi~ESSETH that for and in ¢onsideration <br />of the pro~ises and of the mutual covenants and agreements herein contained, the parties berets <br />hereby covenant and agree as follows: <br /> <br />PA~RT I <br /> <br />LIGHT AN~ POV~ER SERVICE FOR ~INICIPAL BUILDINGS, SCHOOLS <br /> AND WAT~R PU~{PING STATI0~S. <br /> <br /> (1) The Company agrees th. at throughout the term of this ag~eem~t,.i.t <br />will suDply to the City and the City agrees that zt will purchase from the Company all e±ec~rmc <br />energy required by the City for use by the City in ~ll public buildings now owned or hereafter <br />constructed or acquired by the City, and that the Company will supply all electric energy re - <br />~ired by the City for its water pumping stations, sewage pumping plants.and sewage disposal ~ <br />plants, within or outside the co~porate limits of Oity. All such ~leot~zc energy sha.ll be me ~ <br />feted by standard meters to be owned, ~fu~nished and maintained by the Co.mpan.y. All w~res, fix-[ <br />t~res, lamps and appliances used in said buildings shall be o~ed ~d mazntazned by the City. <br /> <br /> (~) Rate. It is agreed between the parties that the Company shaf~l <br />cha~ge and the City shall pay the Co~upany for all electric energy furnished by the Company ~u- <br />de~ this Pa~t I of this agreement at the rate of one cent (l~) net per kilowatt hour, except <br />as hereinafter set forth, with nominimum c~h~ge in effect in ~elation thereto. For all elec- <br />tric energy furnished by the Co, any under this ?a~t I of this agreement to the City between <br />the hours of g:00 P.N. and T:00 A.E. of each day du~ing the termof this agreement fo~ the <br />0ity~s water pumping plants, sewage pumping plants and sewage disposal plants, the City sh~_ll <br />pay the Company at the rate of one-half cent (½~) net per kilowatt hour witch no minimum cha~ge <br />in effect in relation thereto. <br /> <br /> PART II <br /> <br />WHITE ~Y LIGHTING SI~ET~ <br /> <br /> (1): Present System The Comps~y agrees that, throughout the te~m of <br />this agreement, it will continue to keep installed, atits ow~ cost and e~pense, the white way <br />Lighting System now owned by the Company and operated on certain streets of the City as here - <br />inafter described, and that it will operate, maintain, keep clean and ~enew the same without <br />cost to the City - this VZhite ~ay System consisting of one h~nd~ed ~ud-fifty three (10~) single <br />u~it ornamental type b~acket 800 watt multiple incaudesce~ut lamps, of which one hundred aad <br />forty (140) are now located on High Street, one (1) on Eiddle Street, five (§) on Crawford St., <br />t~ee (~) on COunty Street, fo~ (~) on Cou~t Street. <br /> <br /> (~) Future Extensi. on.s. The Company agrees to make the nec.essary ex - <br />tensions of the above-described ~Zite Way Lighting System and ~o. install end maintain such ad- <br />ditional lam~s for ~hite ~ay Lighting as the City may from time to time request, all in accord- <br />ante with the Company's Rules a~d Regulations and at the rates and sub, eot to the conditions <br />applicable to such-service, ~s set out in Part III of this contract. <br /> <br /> STREET, ALLEY, TRAFFIC SIGNAL AND PARK LIGHTING SERVICE <br /> <br /> (1) I~stallation and Maintenance of Lamps The Company agrees that, <br />throughout the term of this agreement, ~t w.zll keep must .al~.. ed, at its own cost and e~pense, <br />candescent lamps, including 'the necessary fixtures and wi~ing (except traffic signals, all of <br />which a~e to be installed and maintained at the cost ~nd expense of the City) at t~he points in <br />the public streets and alleys of the City ~ud pa~ks located ~ithin or outside of the corporate <br />limits of the City ~here such lmmps are now being operated, ~ud at such other points as the <br />Citymay designate, and that it will make a schedule showing the location of said lamps and <br />the character o~ l~mp placed on each location, and will supply the necessary electric cuz~ent <br />for'the operation of said l~mps, and will operate, maintain, keep clean and renew the same upoz <br />the te~s and subject to the conditions h~rein set forth. The fixtures covered by the follow- <br />ing schea~ales, except ~here otherwise specifically designated, shall~ be of the ea~¢e or simila~ <br />design to those ~nich have heretofore been installed by the Company in the City. <br /> <br /> d <br /> (~) N~m~.ber of Street Lamps The City agrees that u~zng the term of <br />this agreement, the number of s'treet lamps to be operated hereunder (exclusive of white way <br />liEhting) shall not be less than an aggregate of 800 (exclusive of traffic siEn~ls). <br /> <br /> (~) Rates The rates ~o be cha~gea by.the ompan~ and p. aid by the 9it' <br />for the lamps of the various-~-~-~s and sizes, for street lightzng p[~u~poses hereinafter specz- <br />fled, all of which are to be operated by the Cpmpany from its dist~bution system a~e as fol - <br />lo%rs: <br /> (~) Net Flat Cha~ <br /> <br /> (a) Overhead series Systems all night (approximately 4,000 ho~vs per year <br /> <br /> <br />
