October 15 .,;1996 96-334(d): "A RESOLUTION AMENDING A USE PERMIT FOR THE OPERATION OF A YOUTH CENTER/CHILD DAY CARE CENTER AT 5815-5851-5901 PORTSMOUTH BOULEVARD. WHEREAS, Girls Incorporated Center for Youth of Southwest Hampton Roads has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to amend Use Permit UP-94-13 permitting the operation of a Youth center/child day care center at 5815-5851-5901 Portsmouth Boulevard on property as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done ali things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement: and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Use Permit UP-94-13, previously granted to Girls Incorporated Center for Youth of Southwest Hampton Roads, is hereby amended pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (1988) to permit the operation of a youth center/child day care center on property located in the City of Portsmouth, said property being more particularly described as: UP-94-13(M) Beginning at a point 650.70 feet east of the intersection of Portsmouth Boulevard and Hodges Manor Road along the southern right-of-way of Portsmouth Boulevard; thence 307.31 feet S77'38'00" E to a point; thence 354.19 feet S7'53'16" to a point: thence 351.93 feet N77'39'00"W to a point; thence 171.47 feet N6'21'00"E to a point; thence 65.18 feet N45'08'00W to a point; thence 126.85 feet N10'05'00"E to the point of beginning. 3. That the use permit is approved subject to the following conditions: (a) in lieu of the wooden stockade fence required by Condition 3 (f) of UP-94- 13, the applicant shall construct landscaping berms, three feet in height, around the sides and rear of the property in accordance with Exhibit A, attached hereto and made a part hereof.
