REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Berm, Clemons Griffin, Martin, Pitts, Robinett, Holley Nays: None - CITY MANAGER'S REPORT - 96-359 - Adoption of an ordinance to amend Chapter 11 of the City Code by amending the title to Chapter 11, by amending Section 11-10 and by adding a new Article III pertaining to excavation within the ABEX Superfund Site. "The Abex Superfund Consent Decree, entered by the Federal Court, requires the City to adopt ordinances govermng excavation within the Superfund Site. These ordinances regulate excavations on public and private property within the Superfund Site area. The Engineering Department will handle the matters of compliance for the permitting process which is required of contractors excavating soils within this area. The giving of notice to EPA and the citizens of excavations is also required of the ~)ermit applicant. I, therefore, recommend adoption of said ordinance." Motion by Mr. Berm, and seconded by Mr. Pitts, to adopt the following ordinance, and was adopted by the following vote: "AN ORDINANCE TO AMEND CHAPTER 11 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING THE TITLE TO CHAPTER 11, BY AMENDING SECTION 11-10 THEREOF AND BY ADDING A NEW ARTICLE III THERETO, PERTAINING TO EXCAVATION WITHIN THE ABEX SUPERFUND SITE." Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley Nays: None 96-360-Adoption of a resolution to approve Amendment No. 27 (Crawford Urban Renewal Plan), Amendment No. 3 (Hattonsville Redevelopment Plan), adoption of a resolution approving the 1997 Action Plan, and adoption of an ordinance appropriating the 1997 Action Plan Funds of $2,226,000 in Community Development Block Grant Funds; $818,000 in 1997 HOME Funds; $400,000 in 1997 Program Income Funds; and the 1997 Emergency Shelter Grant of $58,000 for a total of $3,502,000. A. Adoption of a resolution approving Amendment Number 27 to the Crawford Urban Renewal Plan. This Amendment designates 10 additional properties as "To Be Acquired." B. Adoption of a resolution approving Amendment Number 3 to the Hattonsville Redevelopment Plan. This amendment designates the property at 3113 Ballard Avenue as "To Be Acquired." C. Adoption of a resolution aPProving the 1997 Action Plan and authorizing the City Manager to file documents required to obtain the City's 1997 Community Planning and Development Grant Entitlement.
