568 <br /> <br /> (e) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br /> (f) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Anthony J. Dalla Villa is hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />operation of a bed and breakfast inn to be located at 370 Court Street, being more <br />particularly described as: <br /> <br />UP-96-14 <br /> <br /> Beginning at the northwestern intersection of Court Street and Glasgow Street <br />thence north 30 feet along the western right-of-way line of Court Street to a point; <br />thence west 90 feet to a point; thence south 30 feet to a point; thence east 90 feet <br />along the northern right-of-way line of Glasgow Street to the point of beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) The applicant shall operate the inn in accordance with the requirements of <br />Section 40-52.7 of the Zoning Ordinance. <br /> <br />(b) No more than four (4) bedrOoms shall be used for the bed and breakfast <br /> <br />inn. <br /> <br /> (c) The applicant shall keep a guest register of all guest stays and shall make <br />the register available for inspection to the City of Portsmouth at any time. <br /> <br /> (d) Only overnight guests will be served meals or light refreshments. The <br />establishment will not offer commercial meal service to non-overnight bed and <br />breakfast inn guests. <br /> <br /> (e) No addition or alteration shall be made to the exterior of the structure <br />without approval from the Commission of Architectural Review. <br /> <br /> (f) Prior to issuance of the occupancy permit, the applicant shall provide or <br />make arrangements with the City Traffic Engineer or by other means in accordance <br />with the City Code to insure the availability of seven (7) parking spaces, either on site <br />or within 300 feet of the site. <br /> <br />(g) The use permit is issued to Anthony J. Dalla Villa and is not transferable. <br /> <br /> (h) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments, and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve <br />as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley <br />Nays: None <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Martin, to adopt the following <br />resolution, approved on first reading at the Public Hearing meeting on October 7, <br />1996;, and was adopted by the following vote: <br /> <br /> <br />
