(d) Any proposed revisions to the approved site plan, landscaping plan or elevations must be approved by the Planning Department as consistent with the site plan prier to the issuance of any building permits. (e) Ingress and egress shall be limited to Portsmouth Boulevard. (0 The facility shall be developed and operated in accordance with all other local, state,&nd federal laws and requirements, and all required licenses and permits shall be obtained and maintained in effect. (g) The use permit shall not be transferable. (h) All applicable real estate taxes, personal property taxes, and business license taxes owed on or in connection with the property shall be timely paid, 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Berm, Clemons, Griffin, Martin, Pitts, Robinett, Holley Nays: None Motion by Mr. Berm, and seconded by Mr. Robinett, to adopt the following .~ resolution, approved on first reading at the Public Hearing meeting on October 7, 1996, and was adopted by the following vote: 96-334(b): "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A BED AND BREAKFAST INN AT 370 COURT STREET. WHEREAS, Anthony ,I. Dalla Villa has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a bed and breakfast inn to be located at 370 Court Street, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Is compatible with and will not adversely affect or be materially detrimental to adjacent uses~ residents, buildings, structures, or natural resources; (d) Will be provided with sufficient landscaping to insure compatibility with surrounding uses;
