May 22, 2001 <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is, authorized to execute a deed of conveyance to the <br />Commonwealth of Virginia for the following described property, to-wit: <br /> <br /> Parcel 001 & 002 - Being as shown on Sheet No.'s 3, 4 and 5 of the plans for <br />Clifford Street, State Highway Project U000-124-112, R/W-201 and beginning on the <br />south (right) side of Clifford Street construction centerline from a point on the lands of <br />the Grantor the existing south right of way line of present Clifford Street opposite <br />approximate Station 101 +52 to a point in the lands of the Grantor opposite approximate <br />Station 101+72 and containing 0.002 acre, or 7.68 square meters more or less land; <br />and also beginning on the north (left) side of Clifford_Street construction centerline from <br />a point in the lands of the Grantor the existing north right of way line of present Clifford <br />Street opposite approximate Station 100+01 to a point in the lands of the Grantor <br />opposite approximate Station 101 +58 and containing 0.418 acre, or 1,690.15 square <br />meters more or less, land; together with the permanent right and easements to use the <br />additional areas as being required for the proper construction and maintenance of <br />drainage facilities (right) of approximate Station 101 +11 to Station 101 +15 and also <br />from right of approximate Station 105+38 to opposite approximate Station 105+43, as <br />indicated on plans said area together containing 0.010 acre, or 39.54 square meters, <br />more or less, land; together with the permanent mitigation site (right) of approximate <br />Station 105+04 to Station 105+33 as indicated on the plans and containing 0.172 acre, <br />or 698.98 square meters, more or less, land; together with the temporary right and <br />easement to use the additional area shown as being required for the proper <br />construction for cut and/or fill slopes and containing 0.435 acre or 1,759.55 square <br />meters, more or less. Said temporary easement will terminate at such time as the <br />construction of the aforesaid project is completed. Parcels 001 and 002 together <br />contains 0.420 acre or 1,697.83 square meters, more or less, land. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby authorized to <br />execute such deeds, plats and other documents necessary to effect the conveyance of <br />property herein authorized between the City and the Commonwealth of Virginia as may <br />be required, and to require such deeds and documents to contain such other provisions <br />as he may deem appropriate and in the best interest of the City of Portsmouth, and <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby authorized to <br />execute a Virginia Power Right-of-Way Agreement conveying an overhead right of way <br />as shown on the attached Plat to Accompany Right-of-Way Agreement." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />01 - 171 - Adoption of a resolution authorizing the City Manager to convey two parcels <br />of property, one construction easement and a permanent utility easement on the <br />property in Pinners Point to the Virginia Department of Transportation (VDOT) for the <br />construction of the Route 164 interchange, and for improvements to Martin Luther King <br />Highway. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Manager to convey two parcels of <br />property, one construction easement and a permanent utility easement on the property <br />in Pinners Point to the Commonwealth of Virginia, Virginia Department of Transportation <br />(VDOT). <br /> <br />Purpose and Need: <br /> <br />· Construction of Route 164 State Highway Project 0164-124-F04-RW-201 is part of <br />the improvements being made by VDOT for the proposed new Pinners Point <br />interchange. <br /> <br />Financial Impact: <br /> <br />· The properties to be conveyed in fee simple to the Commonwealth are non-taxable <br />and will remain non-taxable and the easement area is non-taxable. VDOT will pay the <br />City for the property to be obtained upon appraisal of same. <br /> <br /> <br />
