May 22, 2001 Motion by Mr. Robinett, and seconded by Mr. Griffin, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH GEM PORTSMOUTH PARKING, L.L.C., FOR THE PURCHASE OF A PARKING GARAGE IN THE 400 BLOCK OF MIDDLE STREET FOR THE SUM OF $7,000,000. WHEREAS, GEM Portsmouth Parking, L.L.C., ("GEM") has proposed to construct a four-story parking garage on property owned by GEM in the 400 block of Middle Street; and WHEREAS, the proposed structure will meet City parking needs and design criteria; and WHEREAS, upon completion of construction, GEM is willing to sell to the City the parking garage together with the underlying real property for the sum of $7,000,000, and the City is willing to purchase said properties. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to execute, on behalf of the City, a contract for the purchase of the proposed parking garage and underlying real property in the 400 block of Middle Street for a sum not to exceed $7,000,000 and to execute such additional documents as he may deem appropriate for the furtherance of said purchase." Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley Nays: None 01 - 170 - Adoption of a resolution authorizing the City Manager to convey two parcels of property and two permanent drainage and easements, a Virginia Power easement, a permanent drainage and mitigation easement and a temporary construction easement on the property known as the former Seaboard Coast Line Railroad right-of-way and adjacent to the Olive Branch Cemetery to the Virginia Department of Transportation (VDOT) for improvements to Clifford Street and construction of the new Clifford Street Bridge. Recommendation: · Adoption of a resolution authorizing the City Manager to convey two parcels of property and two permanent drainage easements, a Virginia Power easement, a permanent drainage and mitigation easement and a temporary construction easement on the property known as the former Seaboard Coast Line Railroad right- of- way and adjacent to the Olive Branch Cemetery to the Commonwealth of Virginia (VDOT). Purpose and Need: · This action will allow for improvements to Clifford Street and construction of the new Clifford Street Bridge by VDOT and will remain non-taxable. Financial Impact: · After completion of construction by VDOT, this property should be returned to the City of Portsmouth's ownership. Motion by Mr. Benn, and seconded by Mr. Moody, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF CONVEYANCE FROM THE CITY OF PORTSMOUTH TO THE COMMONWEALTH OF VIRGINIA CONVEYING TWO PARCELS OF PROPERTY AND TWO PERMANENT DRAINAGE EASEMENTS, A VIRGINIA POWER EASEMENT AND A PERMANENT DRAINAGE AND MITIGATION EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT ON THE PROPERTY KNOWN AS THE FORMER SEABOARD COAST LINE RAIL RIGHT OF WAY AND ADJACENT TO THE OLIVE BRANCH CEMETERY TO THE COMMONWEALTH OF VIRGINIA (VDOT).
