May 22, 2001 <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF <br />CONVEYANCE FROM THE CITY OF PORTSMOUTH TO THE COMMONWEALTH OF <br />VIRGINIA FOR TWO PARCELS OF PROPERTY IN PINNERS POINT AND A <br />CONSTRUCTION EASEMENT AND PERMANENT UTILITY EASEMENT. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is, authorized to execute a deed of conveyance to the <br />Commonwealth of Virginia for the following described property, to-wit: <br /> <br /> Parcel 081 - Being as shown on Sheet 7 of the plans for Route 164 State <br />Highway Project 0164-124-F04-RW-201 and beginning on the East (Right) side <br />of Ramp F Construction Centerline from the lands now or formerly belonging to <br />the Commonwealth of Virginia opposite approximate Station 35+30 to the <br />existing South right of way line of Marion Avenue opposite approximate Station <br />36+50, and containing 0.044 acre, more or less, land, and being a part of the <br />same land acquired by the Grantor from Pennie Patterson, et vir, by deed dated <br />09/08/77 and recorded in Deed Book 713, Page 126, in the office of the Clerk of <br />the Circuit Court of the City of Portsmouth. <br /> <br /> Parcel 084 - Being as shown on sheet 7-D of the plans for Route 164, <br />State Highway Project 0164-124-F04, RW 201 and beginning on the East (Right) <br />side of Quebec Street construction Centerline from the lands now or formerly <br />belonging to Portsmouth Port & Industrial Commission opposite approximate <br />Station 11+25 to the land now or formerly belonging to Portsmouth Port & <br />Industrial Commission opposite approximate Station 11+85 and containing 0.059 <br />acre, more or less, land, and being a part of the same land acquired by the <br />grantor from Louis Brenner, Special Receiver For Wool & Co., Inc. by deed dated <br />04/06/78 and recorded in Deed Book 725, Page 781 in the office of the Clerk of <br />the Circuit Court of the City of Portsmouth. Parcels 081 and 084 together <br />containing 0.103 acre, more or less, land. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, <br />authorized to execute a deed of conveyance to the Commonwealth of Virginia for <br />easements for possible reconveyance, an easement for the construction, operation and <br />maintenance of VA Power and Commonwealth Gas facilities, together with all <br />necessary attachments and appurtenances thereto and together with the right of ingress <br />and egress thereto over and upon the remaining lands of the Grantor, along and upon <br />the following described property, to-wit: <br /> <br /> Being as shown outlined in YELLOW on the attached plat and lying on the <br />East (Right) side of and adjacent to the proposed East right of way and Limited <br />Access line of the aforesaid route from the lands now or formerly belonging to the <br />Commonwealth of Virginia opposite approximate Ramp F Construction centerline <br />Station 35+34 to the existing South right of way line of Marion Avenue opposite <br />approximate Station 36+50. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby authorized to <br />execute such deeds, plats and other documents necessary to effect the conveyance of <br />property herein authorized between the City and the Commonwealth of Virginia as may <br />be required, and to require such deeds and documents to contain such other provisions <br />as he may deem appropriate and in the best interest of the City of Portsmouth." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
