<br />Beginning at a point on the south right, of-way of High Street West, said point being
<br />176.60 feet west from the southwest intersection of High Street West and Garland
<br />Drive; thence south 494.40 feet, to a point on the north boundary of a land
<br />subdivision as shown and designated on that certain plat entitled "Plat of Property
<br />Belonging to Ezekiel C. and Anna E. Singleton Located Near Churchland"; thence
<br />west along the north boundary of the aforementioned subdivision 56.40, more or
<br />less, to a point; thence southwest along the west boundary of the same
<br />aforementioned subdivision and along the west boundary of an adjoining land
<br />subdivision as shown and designated on that certain plat entitled "Subdivision of Part
<br />of Property Belonging to Anne Clyde Hood Located Near Churchland" 728.0 feet to a
<br />point in the centerline of Sterling Point Creek, also known as Sterns Creek; thence
<br />meandering west along the centerline of Sterling Point Creek, also known as Sterns
<br />Creek 1,324.50 feet, more or less, to a point on the west right-of-way of the former
<br />Seaboard Coast Line Railroad right-of-way; thence north along the west right-of-way
<br />of the aforementioned Railroad 458.40 feet, more or less, to a point; thence east
<br />512.20 feet, more or less, to a point; thence northeast 206.60 feet, more or less, to a
<br />point; thence north 161.50 feet, more or less, to a point; thence northeast 149.90
<br />feet, more or less, to a point; thence east 185.30 feet,~more or less, to a point;
<br />thence north 287.60 feet, more or less, to a point; thence east 72.90 feet, more or
<br />less, to a point; thence north 73.40 feet to a point on the south right-of-way of High
<br />Street West; thence east along the south right-of-way of High Street West 108.40
<br />feet, more or less, to the Point of Beginning.

<br />The above described area contains approximately 17.218 acres.
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site
<br />plan submitted therewith and has recommended conditional approval of said
<br />application; and
<br />
<br /> WHEREAS, the applicant has been informed that approval of the group
<br />housing project pursuant to Section 40-116 only grants an exemption from certain
<br />requirements for residences as stated in said section and does not constitute a
<br />waiver of any other requirement embodied in the Subdivision Ordinance, Zoning
<br />Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local,
<br />state or federal law or regulation; and
<br />
<br /> WHEREAS, the applicant is aware that building permits or any other required
<br />permit will be issued only upon compliance with the ordinances, laws or regulations
<br />applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
<br />
<br />1. That coupled with the terms imposed by paragraph 2 herein, the following
<br />conditions exist:
<br />
<br />(a) The proposed project is compatible with surrounding land uses;
<br />
<br /> (b) The density of the project does not exceed the maximum allowable
<br />density for the zoning district, and, where applicable, the floor-area ratio of the
<br />project does not exceed the maximum allowable floor-area ratio for the zoning
<br />district;
<br />
<br /> (c) The project as a whole conforms to applicable requirements for minimum
<br />required floor area for dwelling units, minimum allowable area for dwelling units,
<br />maximum allowable area for the number of dwelling units, and the maximum
<br />allowable area devoted to residential purposes;
