595 <br /> <br />November 26, 1996 <br /> <br /> (d) The quantity, quality, utility, size and type of the project's open space and <br />landscaping improvements is sufficient to offset the decreases in dimensional <br />requirements or other deviations from the zoning district in which the project is <br />located; <br /> <br /> (e) The project's internal traffic circulation system is adequate to provide for <br />the convenient and safe movement of vehicles and pedestrians and the project will <br />not cause surrounding streets and roads to exceed their safe capacities; <br /> <br /> (f) The quantity, quality, utility and type of the project's community and <br />common facilities are sufficient to offset the decreases in dimensional requirements <br />and other deviations from the zoning district in which the project is located; <br /> <br /> (g) The project complies with the standards for approval of a use permit set <br />forth in Section 40-106 of the Code of the City of Portsmouth, Virginia; and <br /> <br /> (h) The project provides parking, building access and pathways for persons <br />with disabilities in accordance with the requirements of the Americans with <br />Disabilities Act. <br /> <br /> 2. That a group housing use permit for the construction of 66 residential units <br />of sing le-family and duplex style condominiums at 5601 High Street is hereby <br />granted to the applicant, Industrial Development Authority of the City of Portsmouth, <br />Virginia, subject to the following terms and conditions: <br /> <br /> (a) The group housing project shall be limited to 66 residential units of single- <br />family and duplex style condominiums, as shown on Exhibit A, attached hereto and <br />made a part hereof. <br /> <br /> (b) The fror~t facade elevations of each unit shall be primarily of brick. Vinyl <br />siding, stucco or stone may be utilized as minor accent trim as shown on Exhibits B <br />and C, attached hereto and made a part hereof. The ends of all units shall be <br />constructed with full brick facades. Substitution of materials for the brick end facades <br />may be approved by the Planning Commission. Only premium grade vinyl shall be <br />utilized on any facade. <br /> <br /> (c) The proposed project shall comply with the proffered conditions contained <br />in Zoning Amendment Ordinance Z-96-11 and any subsequent amendments thereto. <br /> <br /> (d) The construction methods and materials of roads and water and sewer <br />lines shall be in conformity with city specifications. <br /> <br /> (e) Any required revisions to the site plan, to the landscaping plan, or to any <br />elevation made through the group housing application process, including any <br />changes in response to any requirements by the City Council, must be submitted to <br />the Planning Department for review and approval prior to the issuance of any <br />building permits. <br /> <br /> (f) The applicant and any successor in interest shall corn ply with all applicable <br />statutes, ordinances and regulations of federal, state and local governments and <br />shall obtain and maintain in effect all required permits. Approval of the group housing <br />use permit in no way waives any requirement that appropriate reviews, inspections. <br />and approvals be obtained. <br /> <br /> 3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth. Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the <br />entire project within one year of the adoption of this resolution. <br /> <br /> <br />
