· "0n August llth, 1948, I sold, as Special Commissioner in the suit
instituted by the C.~ty of Portsmouth .against E?ward'L. ~[ahoney and others, the land located
in the marshadj0inmng the Seaboard ALS Line rmght of way near the end of Crawford ~treet. Tax~
es on this' property had not been paid f~ a n~nber of years, . |
~ir. A. E. Parke~r, City Collector, had an ttuderstanding wzth ~ir. Pau~
C. Stok~ey that l~.gtokely would buy the property lying south of the railroad track f c~ the
sum of ~l,000.00. He desires to run a spur railroad track through the property in order that
he may construct a large building on ~ythe Street for T.0. Williams Packing Comps_ny. The pro-
perty to the north of the track has been encroached upon and it is doubti~al that I could de -
liver all of it to the purchaser. Some years ago, ~r. 0.L. Williams conveyed to the City a
40 foot right of way fo~ drainage purpose$. It appears from the survey of t?~ property that
some of trims rzgh~ of way ms zncl~.ded mn the ~ahoney property.. If the Cmty sere ever requm.~d
to purchase the property, in order to establish a drainage syszem, it w,ould ~robably cost con-
s~derable money. Therefore ~ be~eve ~t wou~d be to the ~av~utage of one Czv~ ~o sev~le any
question of title to the land at thms time. Under ~e arrange~n~nts made between ~. Parker an
~Lr. Stokley, the City will be required to pay ~550,00 for whatever land t~hat may lie north of
the railroad: and ~r. Stokley will p ay $1,000,00 for whatever land tha~ lies south of the rail-
road. The City willr ec~ive all of the money on i~s tax bill less a ~mall a_mo~t for court
costs. I therefore request an appropriation of $580.0~ to p ay for the land lying neath of
the' railroad;~'
