283 <br /> <br />June 26th, 1951. <br /> <br />The follow,lng letter from the City Attorney was read: <br /> <br /> "On March 13th you received a petition from the Portsmouth Coal and Ice Company for a <br />refund, of $312~50 for taxes paid on personal property, with a letger at~tached from L. E. Turlington, Commissioner <br />of the Revenue, recommending the refund. Upon iuvestigation, I 'fo~mud that the assessment had been made on cert ~ain <br />property which had been returned by the Atlantic Company to the Commonwealth of Virgiuia es capital invested, end <br />taxes had been paid to the Commonwealth. Under the decision of City of Rosnoke vs. Mashael:s Bakery Company 180 <br />Va. 132, the City of ~ortamouth had no right to assess the property end the sum of $312.50 should be refunded." <br /> <br />Motion of Mr. Bilisoly to appropriate $312.50 for said purpose was adopted, end by .the <br /> <br />following vote: <br /> <br />Ayes: <br /> <br />Nays: <br /> <br />Duke, Bilisoly, Grimes, Houghton, Howard, Smith, Sturtevant, <br /> Warren, I~eisemen, Wilson <br />None <br /> <br />The following ordinance placed on its first reading at the last meeting, was taken up <br /> <br />and read: <br /> <br />"kN ORDINANCE REQUIRING DEALERS IN JUNK AND SECOND HAND ARTICLES <br /> TO P2%KE RECORDS OF PURCHASES AND FILE SA~. Weiseman to appropriat~ $7,500.00 for said purpose, was adopted, and by <br /> <br />the following vote: <br /> <br />Nays: <br /> <br />Duke, Biiisoty, Grimes, Houghton, Howard, Smith, Sturtevent, <br /> Warren, Weiseman, Wilson <br />None <br /> <br /> ~a appropriation of $3,000.00 for air-conditioning the City Collector's office, placed <br />on its first reading at last meeting, was taken up. <br /> <br /> Motion of Mr. Weiseman that the City Manager investigate the mainte_ance cost of the <br />two types of equipment on which bids have been received, and that it be left to the discretion of the City Manager <br />to make the award to the best advantage of the City. <br /> <br /> An appropriation of $3,000.00 for lighting the playground area adjacent to the Truxton <br />School, placed on its first reading at last meetim~, was taken up. <br /> <br />followingvote: <br /> <br />Motion of Mr. Grimes to appropriate $3,000.00 for said purpose, was adopted, and by the <br /> <br />Ayes: <br /> <br />N - <br /> <br />I~ke, Bi!isoly, Grimes, Houghton, Howard, Smith, Sturtevant, <br /> Warren, Weiseman, Wilson <br />None. <br /> <br />NEW B~JSINESS - <br /> <br />The following petition was presented: <br /> <br /> "We, the undersigned property owners, petition the City of Portsmouth, through our <br />Councilman, C. E. Warren, to remove the sand and gravel from Sixth Street, between Fayette end Henry Streets, and <br />to hard-surface these blocks. This sand and gravel waw placed on these three blocks a few months ago, m~king it <br />impossible to keep the house.s, porches or street decent with the sand constantly flying from passing cars and <br />the wind. <br /> Further, we ask for motor street cleaning service. We can not remember the last time <br />our street was swept, and we feel we are e~titled to this service, just as much as other parts of the City. <br /> <br />Signed - Annie L.
