March 25. 1997 97 - 70 - Use permit: Motion by Mr. Robinett, and seconded by Mr. Martin, to adopt the following resolution, approved on first reading at the March 11, 1997 Public Hearing meeting, and was adopted by the following vote: 97- 70 (cJ: "A RESOLUTION GRANTING A USE PERMIT FOR THE CONSTRUCTION OF A COMMUNICATIONS TOWER AT 3705 GATEWAY DRIVE. WHEREAS, AT&T Wireless PCS, Inc., has made application pursuant to SeCtion 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to construct a communications tower to be located at 3705 Gateway Drive, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done al things required to be oone in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That AT&T Wireless PCS, Inc., is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the construction of a communications tower located at 3705 Gateway Drive. and being more particularly described as: UP-97-01 Beginning at a point approximately 260 feet from the southeast corner of the intersection to Twin Pines Road and Gateway Drive; thence southeast approximately 202 feet; thence northeast approximately 280 feet; thence southeast along the southern right-of-way line of Gateway Drive approximately 415 feet; thenoe southwest approximately 287 feet; thence southwest approximately 49.5 feet; thence northwest approximately 752 feet to the eastern right-of-way of Twin Pines Road; thence northeast approximately 58 feet to the point of beginning.
