March 25, 1997 <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) The tower shall not exceed the height of 480 feet and shall be equipped <br />and made available to accommodate additional Users. <br /> <br /> (b) The location of the tower and any accessory building or structure <br />associated with the tower or any antenna located thereon must comply with the <br />provisions of the City's Chesapeake Bay Preservation Ordinance. <br /> <br /> (c) The style of the tower shall be similar to the guyed ~ohn 90 tower. The <br />exterior of the tower shall be an unpainted galvanized finish. No markings or lighting <br />shall be used on the tower unless required by the Federal Aviation Administration <br />(FAA). <br /> <br /> (d) The tower shall comPly with all Federal Aviation Administration safety <br />requirements and guidelines for a tower of its height. <br /> <br /> (e) The use permit shall become void if the tower becomes unused or <br />obsolete. In the event that the permit becomes void, the tower shal'l be removed <br />within 12 months. <br /> <br />(f) No signs or advertising may be attached to the tower. <br /> <br /> (g) Accessory facilities associated with any antennas attached to the tower <br />may be located in an existing building on the property. Prior to installing any <br />equipment, improvements must be made to the building so that it meets the <br />minimum requirements of City Code. <br /> <br /> (h) Prior to issuance of a building permit, the applicant must submit plans to <br />the Building Official, certified by a qualified professional engineer, that the tower will <br />meet all requirements of the building code and the requirements of EIA-222F, <br />Structural Standards for Steel Antenna Towers and Antenna Supporting Structures. <br /> <br /> (i) Prior to issuance of a building permit, the applicant must provide the <br />Director of Planning with a statement from a qualified professional engineer, that the <br />non-electromagnetic radiation (NICER) emitted from the proposed facility, and any <br />adjacent facilities, will not result in ground level exposures exceeding standards <br />established by any U~S. Government Agency and the American Standards Institute. <br /> <br /> (j) The tower, any accessory building or structure, and any parking area shall <br />be screened by a Landscaping Group 3 buffer as defined in the City of Portsmouth <br />Zoning Ordinance. The nature and location of the required buffer shall be <br />established by a landscaping plan which must be submitted to the City's Division of <br />Planning and Zoning and approved prior to the commencement of construction of the <br />tower. At all material times during the use of the tower and the associated facilities, <br />the required landscaping buffer shall be maintained in good condition, and any dead <br />plantings shall be promptly replaced by the applicant or its successor in interest. <br /> <br /> 4. EXPIRATION OF PERMIT: If operation of the facility is not commenced <br />within two years of the date hereof, the use permit shall expire. <br /> <br /> 5. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Robinett, HOlley <br />Nays: Pitts <br />Abstained: Martin - LaW firm represents the applicant. <br /> <br /> <br />
