March 25. 1997 Motion by Mr. Robinett. and seconded by Mr. Griffin, to adopt the following resolution approved on first reading at the March 11, 1997 Public Hearing meeting, and was adopted by the following vote: 1. Frank Blount. 925 48th Street. Newport News, VA, provided information on the use permit. 97-41(e): "A RESOLUTION GRANTING A USE PERMIT FOR THE CONSTRUCTION OF A COMMUNICATIONS TOWER AT 3850 BROADWAY STREET. WHEREAS, Area Wide Communications, Inc., has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to construct a communications tower to be located at 3850 Broadway Street. Portsmouth, Virginia, as hereinafter-described; and WHEREAS. the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW. THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virg~ nia: 1: That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood (c) Will be provided with sufficient landsCaPing to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Z?ning Ordinance. 2. That Area Wide Communication, Inc.~ is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the construction of a communications tower located at 3850 Broadway Street, and being more particularly described as: UP-96-29 Beginning at the northwest corner of the intersection of Lombardy Avenue and Broadway Street; thence southwest, along the northern right-of-way of Broadway Street approximately 160 feet; thence southeast approximately 335 feet to the northern right-of-way of Adams Street; thence southwest, a!ong the northern right-of- way of Adams Street, approximately 570 feet; thence northwest approximately 335 feet; thence southwest approximately 280 feet; thence northwest approximately 344 feet; thence northwest approximately 244 feet; thence northeast approximately 494 feet; thence southeast approximately 278 feet; thence northeast approximately 380 feet; thence southeast approximately 272 feet to the point of beginning.
