.1,62 June 24, 1997 <br /> <br /> WHEREAS, the advancement of the work and use of the property cannot <br />proceed until it has been acquired and the use of the property will be unreasonably <br />delayed if the property is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> That the City Attorney be, and he hereby is, directed to institute eminent <br />domain proceeding, or cause such proceedings to be instituted against the <br />hereinafter described property situate in the City of Portsmouth. Virginia, for the <br />purpose of acquiring fee simple title thereto pursuant to Sections 2.06, 2.07 and 2.08 <br />of the Charter of the City of Portsmouth, Virginia, as amended, said property being <br />Lot 31 as shown on the plat known and designated as "Plan of Tabb's Land", which <br />said plat is duly recorded in the Clerk's Office of the Circuit Court of the City of <br />Chesapeake in Deed Book 81 at page 470. <br /> <br /> The names of the property owners are James L. Canady and Mattie Lee <br />Canady, their heirs and devisees and/or parties unknown. <br /> <br /> The property has been appraised for $3,400.00. and suchsum as the Court <br />shall order as compensation shall be paid according to order of said Court." <br /> <br />Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley <br />Nays: None <br /> <br /> Motion by Mr. Martin, and seconded by Mr. Robinett, to adopt the following <br />resolution and was adopted by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY ATTORNEY, OR HIS <br />[:)ESIGNEE, TO ACQUIRE BY EMINENT DOMAIN PROCEEDINGS PROPERTY <br />OWNED BY BETTY RIDLEY, HER HEIRS AND DEVISEES AND/OR PARTIES <br />UNKNOWN, SAID PROPERTY BEING NECESSARY TO PROMOTE THE HEALTH <br />SAFETY AND WELFARE OF THE CITY AND ITS INHABITANTS. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virg~ nia has determined <br />that it is in the public interest to redevelop the area of the old Riddick-Weaver <br />School, and <br /> <br /> WHEREAS the City has not been able to acquire the property described <br />herein, which property is necessary to the project, because the owners of said <br />property cannot be found so as to acquire said property by other means, and <br /> <br /> WHEREAS the advancement of the work and use of the property cannot <br />proceed until it has been acquired, and the use of the property will be unreasonably <br />delayed if the property is not made available as soon as possible. <br /> <br /> NOW.
