.1,62 June 24, 1997 WHEREAS, the advancement of the work and use of the property cannot proceed until it has been acquired and the use of the property will be unreasonably delayed if the property is not made available as soon as possible. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: That the City Attorney be, and he hereby is, directed to institute eminent domain proceeding, or cause such proceedings to be instituted against the hereinafter described property situate in the City of Portsmouth. Virginia, for the purpose of acquiring fee simple title thereto pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth, Virginia, as amended, said property being Lot 31 as shown on the plat known and designated as "Plan of Tabb's Land", which said plat is duly recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake in Deed Book 81 at page 470. The names of the property owners are James L. Canady and Mattie Lee Canady, their heirs and devisees and/or parties unknown. The property has been appraised for $3,400.00. and suchsum as the Court shall order as compensation shall be paid according to order of said Court." Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley Nays: None Motion by Mr. Martin, and seconded by Mr. Robinett, to adopt the following resolution and was adopted by the following vote: "A RESOLUTION AUTHORIZING THE CITY ATTORNEY, OR HIS [:)ESIGNEE, TO ACQUIRE BY EMINENT DOMAIN PROCEEDINGS PROPERTY OWNED BY BETTY RIDLEY, HER HEIRS AND DEVISEES AND/OR PARTIES UNKNOWN, SAID PROPERTY BEING NECESSARY TO PROMOTE THE HEALTH SAFETY AND WELFARE OF THE CITY AND ITS INHABITANTS. WHEREAS, the Council of the City of Portsmouth, Virg~ nia has determined that it is in the public interest to redevelop the area of the old Riddick-Weaver School, and WHEREAS the City has not been able to acquire the property described herein, which property is necessary to the project, because the owners of said property cannot be found so as to acquire said property by other means, and WHEREAS the advancement of the work and use of the property cannot proceed until it has been acquired, and the use of the property will be unreasonably delayed if the property is not made available as soon as possible. NOW. THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: That the City Attorney be, and he herebyis', directed to institute eminent domain proceeding, or cause such proceedings to be instituted against the hereinafter described property situate in the City of Portsmouth. Virginia for the purl~ose of acquiring fee simple title thereto pursuant to Sections 2.06. 2.07 and 2.08 of the Charter of the City of Portsmouth, Virginia, as amended, said property being Lot 33 as shown on thb plat known and designated as "Plan of Tabb's Land", which said plat is duly recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake in Deed Book 81 at page 470.
