It must be remembered that these procedures are followed by each individual tenant <br />For example, as we have been able to increase our land acquisition, the size of this particular shopping center <br />has been increased on three different occasions. Tenants who flatly decline'd interest in the original proposition <br />have in some instances now agreed to occupy space if the curren~ proposal becomes a reality. Moreover, certain <br />tenants who had planned.smaller stores under the original proposal have now agreed to larger stores under the <br />present planning. It must be remembered ~hat each lease is interdependent upon other leases in that certain stores <br />will occupy the center only if certain other stores specified by them agree to occupancy. <br /> Because of our understand~ing that ~hese streets were tO be cl'osed, we ~onveyed title <br />to the City of Portsmouth, Virginia to what is now known as U.S. Route 17-A at a price considerably below its <br />market value. Further, we understood that a contractual obligation to close the subject streets existed between <br />the Bureau of Public Roads, Virginia Department of Highways and the City of Portsmouth. On the basis of the basis <br />the foregoing, we have re~resented to all interested pa~ii~ that the present proposal would embrace the property <br />shown on the attached plat. The recent action of the Council imposes upon us the obligation to re-submit a re - <br />vised plan showing the lesser site for decision of the individual tenants which will determine the future of Mid- <br />City Shopping Center. It must be remembered that we are requesting these organizations ~o locate in PortSmouth, <br />and as such, we are not in a position to demand their acceptance nor to demand an early response to our inquiry. <br />Wit~ou~ a do~bt, had Vermont Ave. been closed, the shopping center would go ahead as the signed leases were <br />based on that p~oposition. <br /> We have gone into these matters in considerable detail in order that members of <br />the Council understand the difficulty of a definite, concise answer to the question propounded in paragraph one <br />of your letter dated May 20, 1957." <br /> <br />Motion o£ Mr. Smith that the letter be received and filed, was adopted. <br /> <br />57-191 - "I am reporting that I have discussed with the Sheriff of Norfolk County the rate <br />that the Board of Supervisors have fixed for lodging women prisoners in Norfolk County Jail on State, offenses. <br /> Under State law tbe Commonwealth of Virginia. pays the full cost of the. food and <br />other expenses in connection with the lodging of prisoners committed on State offenses. The Code provides that a <br />county or city may charge s reasonable fee for lodging prisoners for another political subdivision within the <br />State; however, in my opinion, the cost of $1.00 per day is out of line with the rental ~f other properties <br />within the City. <br /> The City new.pays the County $2.00 per day for prisoners committed to the County <br />Jail on City offenses and the average prisoner days for the three.months previous was 958 while there were 1129 <br />prisoner days committed on State offenses, making ~ total of 2,087 prisoner days. For the month of February the <br />most recent month I have available, the cost at the City Jail for a prison day was $:~8; however, Sherif£ Hedges <br />informs me that his cost is approximately $1.00 per day. Allowing the County ~he rate of $1.00 per day per pris- <br />oner we would thBn b~ paying at the rate of $1.00 per day per prisoner for rental of the jail and based on the <br />same figure for State prisoners at $1.00 per day per prisoner would mean that.for the previous three months the <br />City would pay to Norfolk County the rate of $696.00 per month for the use ~f the County Jail. Rased on the rate <br />that the City charges the County for rental of the Treasurer's office and ~he Trial Justice Court, I am of the <br />opinion that the cost is too high and recommend that a conference be arranged between representatives of the City <br />and representatives of the County to determine if this cost can not be adjusted downward." <br /> <br /> Motion of Mr. Hinton 5o concur in the recommendation o£ the City Manager, was adopte, <br /> <br /> 57-192 - "I have conferred with A J Mapp, Sr., Superintendent of Public Schools and it appear~ <br />that a conference between the School Board and the City Council,can not be held until sometime during the month o: <br />June. Mr. Mapp is to confer with Board members to determine the dates on which the School Board could meet with <br />the Council and the dates will be submitted to Council for their consideration to determine if such dates would <br />be agreeable." <br /> On motion filed. <br /> <br /> 57-193 - "I am submitting a reques~ for relief of taxes on the ~roperty known as 934 A St., <br />which has recently been purchased by the Park View Baptist Church, for Sunday Schoo~ purposes. I recommend that <br />the Council relieve the taxes for the remainder of the year - in the amount of $62.74." <br /> <br /> ~otion of Mr. Smith ~hat taxes be relieved was adopted. <br /> <br /> 57-194 "I submit an agreement for a .right of way for storm drainage from the Foundation <br />Boys ~cadeJny and recommend that the proper city o£~icial be authorized and directed to execute the agreement for <br />and on behalf of the City and that the Clerk attest the same and.affix~the City's seal thereto." <br /> <br /> Motion of Mr. Hinton that proper.officials be authorized 5o sign the agreement, was <br />adopted. <br /> <br /> 57-195'- "I submit the attached letter from Wiltard~ J..Moody, Attorney, concerning compensa- <br />tion of Police officers who attend court during Their of£-duty hours. I recommend that this ma~ter be considered <br />in connection with the ~udget and further reques$~that the_Council has concerning salary increases." <br /> <br /> Motion of Mr. Weiseman to re£er to the Budget Conference, was adopted. <br /> <br /> 57-19~ - "I am submitting a letter fromthe Executive Director of the United States Conference <br />of Mayors concernln~ Federhl taxation'oh Municipal ~bnds. <br /> This matter has been before Congress for a number of years and municipalities have <br />been'able to def~t the legislation that has been p~oposed whereby municipal bonds would be su. bject To federal <br />taxation, <br /> In the past the City of Portsmouth has opposed such legislation and I recommend <br />that the Council adopt a Resolution opposing such legislation and that a copy be sent to our Representatives in <br />Congress and the Senate." <br /> <br /> Motion of Mr. Kirby to concur in the recommendation of the City Manager,was adopted <br /> <br /> 57-197 - "I am submitting the a~tached amendment to the City Code increasing Taxi-fares in two <br />~tegories and recommend that"it he placed on first reading." <br /> <br /> <br />
