"I am submitting ior ~yonr consideration the ,pnoposed fare increases from the <br />PorTsmouth Tranzit Comply and also s schedule ~of service after 9:3Q P.M. submitted by the Company." <br /> Motion of Mr. Hinron that this matter be referred to the Transportation Committee for <br />investigation and recommendation, was adopted. <br /> <br /> Mr. Smith stated that he wished To go on record as protesting the re-routing <br /> of <br /> the <br /> <br />buses. <br /> 58-59 - "I submit the proposed Welfare Budget that has been prepared by the Social <br />Service Bureau and recommend that it be tentatively approved and forwarded to the State Department of Public Wel- <br />fare for their consideration and that the City Manager be directe~ to incorporate in the regular City Budget the <br />%~lfare Budget as it may be finally approved." <br /> <br /> Motion of M~. Warren, C]iief of Pol~c . <br /> <br />On motion filed. <br /> <br /> 58-62 - "It is in order at this time to consider the report of the City Attorney on <br />the o~dinance or contract governing building of one story building on High St., as requested by Councilman Baker. <br /> This item was left off the agenda that was sent to yon last Friday as Mr. <br />Livesay did nor know whether he would have ~his information available ~o report tonight." <br /> <br /> "At the meeting of Council on February ll, 1958, Councilman B.W. Baker requested that <br />I investigate and report to Council concernihg the construction of a one s~ory building on the land owned by the <br />City, lying on High Street bezween Court and Middle'Streets. <br /> After considerable ~e~earch, I have determined that an ac~ of the General Assembly, <br />passed January 25th, 1905, is the authority under~ which the subject property was leased for 99 years renewable <br />forever. Pursuant To this Act, the Trustees of the Town of Portsmouth, on March 23, 1805, adopted the following <br />ordinance: <br /> 'Ordered that the remainder of the court house lot be advertised for lease on the <br />third Monday taM ay next ro the highest bidder on a lease for 99 years renewable forever in four equal parts~ t~e~l <br />lessee of each lot ro erect a house nol less than 24 feet square and two story high and to be sub3ect to such othe~ <br />regulation as the Act of Assembly points out which passed the 2/tth January '05~' ~ <br /> The original leases incorporated by reference the above-mentioned Act of Assembly, <br />which does not refer to size or height of buildings, but the leases do not incorporate the ordinance of the Town <br />Trustees or specify the size or height of buildings to he erected on the property. While it is not free from <br />doubt, I feel that a fair case could be made of the conmention that the'ordinance and advertisement pursuan~ <br />thereto are properly considered as terms of the leases even though no~ referred ~o therein. <br /> However, this morning the present owner of the leasehold interest in 2½ of the ori- <br />ginal 4 lots p~esented plans ro the Building Inspector for his approval and issuance of a building permit.
