May 12th, 1959. <br /> <br />As many of you know, industry is already being driven away from many large urban centers for various reasons. <br />In fairness to those who conceived the presently proposed ordinance, it appears that consideration was given to <br />the effect of this tax qn industry since no tax will be imposed on that portion of a monthly bill which exceeds <br />$200. So much on our reeling'toward this hype of tax in general. <br /> If Council feels that ~udget requirements are such that increased taxes must be im - <br />posed on utility services, it is obviously necessary to change the present ordinance. It is.mur feeling that <br />the proposed ordinance takes intQ accounn and reduces some of the discriminatory features whioh so often exist. <br />We would naturally, rather M ye all excise taxes removed. Next to that we would rather have no additional taxes <br />imposed. If neither of these courses are possible in order to meet the budget needs of the City, we are of the <br />belief that the propoeed ordinance is as satisfactory as can ~e designed." <br /> <br />ion of Mr. Weiseman to place the following ordinance on first reading was adopted: <br /> <br />"AN ORDINANCE TO AMEND ARTICLE VI OF CHAPTER 8 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1951, CONSISTING OF SECTIONS 8-53 to 8-62, INCLUSIVE, <br />THEREOF, IMPOSING AND LEVYING A TAX EFFECTIVE AS PROVIDED THEREIN, AND ALSO <br />FOR EACH AND EVERY FISCAL YEAR THEREAFTER BEGINNING JANUARY 1 AND ENDING <br />DECEMBER 31 OF EACH SUCH YEAR, UNLESS OTHERWISE CHANGED BY COUNCIL, ON PERSONS <br />PURCHASING CERTAIN UTILITY SERVICES FURNISItED WITHIN THE CORPORATE LIMITS OF <br />THE CITY OF PORTSMOUTH, DEFINING CERTAIN TERMS, INCLUDING THE TERM ~b~ILITY <br />SERVICE', FIXING THE AMOUNT OF SAID TAX, PROVIDING FOR THE COLLECTION THEREOF, <br />AND PRESCRIBING PENALTIES FOR ITS VIOLATIO~ <br /> <br /> 59-124 - "I~sub~it the following ordinance and recommend that it be placed on first <br />reading.-Tkis ordinance amends the Cigarette Tax Ordinance to include a tax on all forms of tohaGco.. The rate <br />on cigarettgs does not change~t adds a tax of .$0.01 or fractional part ~hereof of the retail price at which <br />any other tobacco product is sold. <br /> These funds will go into the operating budget of the City. <br /> <br />On motion of Mr. Weisgman, the following ordinar~ce was placed on first reading: <br /> <br />"AN OBDINAMCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGI~Lk, 1951, <br />BY ADDING TO CHAPTER 8 'riL~REOF A NEW ARTIQLE NUMBERED VIII, LEVYING AND <br />IMPOSING A TAX ON EVERY SALE, AS DEFINED THEREIN, OF TOBACCO PRODUCTS <br />WITHIN TH~ CITY OF PORTSMOUTH, DEFINING CERTAIN WORDS AND PHRASES ~SED <br />THEREIN, FIXING THE RATE AND AMOUNT OF SAID TAX, PROVIDING FOR THE <br />PAYMENT AND COLLRCTION THEREOF, AUTHORIZING THE DIRECTOR OF FINA-N-CE TO <br />MAKE CERTAIN RULES AND REGULATIONS REGARDING THE ADMINISTRATION OF SAID <br />ARTICLE, DEFINING VIOLATIONS OF THE PROVISIONS OF S~ID ARTICLE AtfD <br />PRESCRIBING PENALTIES THEREFOR." <br /> <br /> 59-125 - "I am submitting the at~ached agreement with the Virginian Railroad and <br />recommend tha~ the proper city offici~lsbe authorized to sign. This agreemen~ permits the Portsmouth Water <br />Department to flood certain land of the Virginian Railroad located in Nansemo~d County. This agreement also re - <br />quires the Virginian Railroad to perform certain work on'its road bed andgives the Water Department the right <br />to remove all trees and vegetation as may be required ~o protectthe quality of th~ water impounded. <br /> This is necessary for the construction of Lake Meade," <br /> <br /> Motion of Mr. Smith to concur %n the recommendation of the City Manager and tha~ the <br />proper city officials be authorized to sign the agreement, was adopted, without dissenting vote. <br /> <br /> 59-126 - "The City proper~y at 528 Queen Street was auctioned on May llth, 1959. There <br />was one bid by Monsignor Goevart, in the amount of $22,000.00. <br /> I recom~.end that this property be sold to Monsignor Goevart for the sum <br />of $22,000.00 and t~hat the funds be deposited in the General Capital Improvement Fund." <br /> <br /> Motion of Mr.. Bartlett to concur in the recommendation of the City Manage~ was adoptel, <br />without <br /> dissenting <br /> vote. <br /> <br /> 59-127 - "The City property at the corner of Chestnut and County Sts. was auctioned <br />on NL~y llth, 195~. The highest bid was from A.A. Bangel in the amount of $1,.050.00. I recommend that'this bid <br />be rejected." <br /> <br /> Motion of Mr. Breedlove to concur in the recommendation of the City Manager was <br />adopted, without dissenting vote. <br /> <br /> 59-128 - "Bids were qpened on May llth, 1959, for a new lighting system in the <br />Municipal~lStadium.
