November 27, 2001 01 - 330 - Adoption of a resolution authorizing the City Manager to convey a variable width water transmission easement to the City of Norfolk in the area adjacent to Clifford Street in connection with the replacement of the Clifford Street Bridge. Recommendation: · Adoption of a resolution authorizing the City Manager to execute all necessary documents to convey a variable width water transmission line easement to the City of Norfolk across property adjacent to Clifford Street and lying behind Simonsdale Elementary School. Purpose and Need: · This easement is needed in order that the Virginia Department of Transportation (VDOT) may relocate the present 30" water transmission line of the City of Norfolk several feet further south of the right-of-way of Clifford Street, which is being improved by VDOT in connection with the replacement of the Clifford Street Bridge. · Council adopted a resolution at its meeting held on May 22, 2001 granting necessary easements and right-of-way to VDOT for the Clifford Street improvements project. · Relocation of the water line will begin while VDOT completes the bidding process. Financial Impact: · The Clifford Street project is being carried out by VDOT and all improvements should be returned to the City of Portsmouth when the project is complete. VDOT is contributing 98% of the cost of construction, and the City is contributing the remaining 2%. Motion by Mr. Benn, and seconded by Mr. Pitts, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY A VARIABLE WIDTH WATER TRANSMISSION EASEMENT TO THE CITY OF NORFOLK IN THE AREA ADJACENT TO CLIFFORD STREET. BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to grant and convey a variable width water transmission line easement of approximately 30' in width to the City of Norfolk, Virginia for the purpose of relocation of the City of Norfolk's 30" water transmission line, a portion of which is now located in Clifford Street as shown on that certain plat entitled "Proposed Permanent Utility Easement Exhibit for the City of Norfolk". BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute such deeds, plats and other documents necessary to effect the conveyance of property herein authorized between the City of Portsmouth and the City of Norfolk as may be required, and to require such deeds and documents to contain such other provisions as he may deem appropriate and in the best interest of the City of Portsmouth."
